The real question is whether the 40 votes exist or not.  As pointed out in The Hill piece, Franken will not get a certificate of election if Coleman challenges the election in court.

So all one has to do to prevent certification is to challenge in court?

So Coleman's campaign agreed to count 950 ballots today, yesterday, but today they were all like nooooooooo legal stop don't count them, but then today again they changed their mind and said ok maybe count them go ahead

Will Cornyn or someone plan to draw a distinction between the seating of Franken compared to Burris in the Senate? Both will arrive with official credentials from their state and both with a legal cloud surrounding the credentials for that seat. It's true that one is an election and one is an appointment, but is that enough to draw the distinction?

While it is a coincidence that there are these two cases at the same time, they actually are fairly different. Only extreme Republican hacks would think that there was something wrong in provisionally seating the man who got the most votes in the Minnesota election. The Illinois situation has more complicated legal and ethical issues.

Ahh the suspense.

I turned on the live stream and heard the guy say Franken 7 times in a row. And it was funnier than I had just described it. It was probably the guy's voice...

While not official, Al Franken will almost certainly be the next senator from Minnesota.  He is ahead by 226 with the last vote counted.

There will be court challenges, but I don't think it will change much.

It's truly a great day for Minnesota to see Chameleon Coleman booted out of office.

While not official, Al Franken will almost certainly be the next senator from Minnesota. 

Barring assassination or other physical impairments or a scandal bigger than Sam's to force him to resign.

I agree that there are substantially different ethics between the IL Gov and the MN Canvassing Board, but that is exactly what the Powell case says is irrelevant to Senate seating. If Coleman files a court challenge, both Franken and Burris will have equally deficient certification credentials to present to the Senate.

The Senate should provisionally seat the obvious winner while the frivolous challenges are being dealt with. Coleman wanted to steal the election like Bush did in 2000, but he lost fair and square.

Hooray !!!!! what a prefect way to end a great election season I know there are a lot of people who don't like Al Franken they might think he is too partisan or he has said some offensive jokes in the past but I find him to be a person of character regardless of how others see him. 

as much as I hate labels this really has been a good election season for people who consider themselves to be somewhat liberal. watching obama and franken win,  the Dem's gaining 59 seats really would have been unimaginable in 2004. we shall see what the next four years will bring, I can only hope for the best for our nation and are new president:).

as for are conservative friend's cheer up politics Eb's and flows, the republicans will be back they will probably gain a lot of seats in 2010. they will be back by 2016 or maybe even before that depending on how popular obama is. only time will tell, I'm hoping for the best.
