The vacancy will be filled by a vote for the combined New York State legislature (Senate + Assembly). Cuomo has no legal power regarding appointment here (obviously he will have significant influence).

Kathleen Rice is hilariously awful: This is a person who sits in a seat Obama and Clinton both won with ease who happily voted to roll back the ADA just a few months ago, so of course she'll win this race with ease and will probably succeed Cuomo (or, I guess, Gillibrand) when the time comes.

I'd rather have Rice than the chance of electing Dan Donovan.

That said, I'd also have Rice as my Congressperson, so this is a bad move.

Besides, If Gillibrand gets elected, the person picked to replace her probably depends on who wins this year's primary. If Cuomo wins, I would guess it'll be Thomas DiNapoli, or Kathy Hochul.

If Nixon wins, Jumaane Williams or Bill De Blasio seem possible.

Don't rule out Chelsea Clinton as a Senate appointment either, just like her mother.
