Thanks Napoleon. Here's how I'd like to run this. I'd suggest each member takes a certain year (or so) of Northeast statute and reviews it, paying particular attention to:

- any new loopholes or regulatory questions that the bill creates
- contradictions with other legislation
- its compliance with the NE Constitution
- whether the bill was passed in a legitimate manner, if such a thing can be ascertained

If you have recommendations that you think the Assembly would be prudent to accept, please make a note of those, and provided the rest of the SRC is in agreement, it will be put in the final report.

Also, as you review the statute, please put together a document containing all of the laws passed up to the present day that can be presented as a complete portion of the Northeast Statute.

Once we decide which portions of the statute will be reviewed by whom, I think we ought to take four days on the review process, reconvene formally for consideration of progress that is being made or difficulties being encountered, then take another four days to finish the review. With the remaining time, we will assemble and deliberate upon a report to present to the Assembly.

Any suggestions/objections? Any preferences as to a specific time period for the review?

Timeline-wise, we have to not mistake the need for action with needing to act precipitously.

I think we should aim to have a set of recommendations to deliver to the Governor/Assembly by the end of the current session of the Assembly at the very least. It gives us enough time to really look into the matter as well as develop the recommendations.

Keep in mind, though, that according to the legislation passed by the Assembly, the SRC's commission to review the statute extends only until the fifteenth calendar day after the passing of the bill, which would be next Saturday. If we need an extension of the commission, we can certainly ask the Assembly for it, but my goal in limiting the review period was to get things done quickly so that the Assembly can legislate with confidence in the integrity of the statute.

Certainly a well thought and admirable goal, and I hope to get to work straight away. Fortunately we have enough Constitutional amendments to take care of that legislation probably will have to wait until the report is ready simply because of that fact. I'd still like toner our deadline though.

Feel free to assign me a time period or something to look into. :)

While I agree that it should be done quickly - the timeline in the legislation for the Commission is, in my view, too short.

However, I'm happy to work to that legislated time frame.

We should get to work on it, and then come to a consensus this weekend as to whether we should ask the Assembly for more time.

I'll break up the legislation into blocks like so:

Feel free to ask any questions, and please use this thread to bring up any suggestions, concerns, advice, etc. as you work.

I am not done yet, but this (https://uselectionatlas.org/AFEWIKI/index.php/Northeast_Tort_Reform_Bill) should probably be reconciled with this. (https://uselectionatlas.org/FORUM/index.php?topic=119914.msg2607732#msg2607732) (I am 99% sure that it passed in the Assembly.)

Recall Amendment—apparently did not pass properly, could also use clarity. I recommend:

1. The Citizens of the Northeast Region may recall any regional  officer.
2. Any registered Northeast voter may open a recall petition on any regional officer at any time, for any reason.
3. If said petition receives the signatures of eight registered Northeast voters, an election is to be held immediately after 24 hours have passed. Candidates seeking to replace the officer being recalled are to declare during this 24 hour period.
4. The voting booth is to remain open for three days, and shall be held by the Chief Judicial Officer, unless it is the Chief Judicial Officer's own recall, in which case it shall be held by the Governor.
5. If, in said vote, a simple majority are in favor of the recall of said regional official, that official shall be stripped of the position. The candidate who receives the most votes is considered to be elected to fill that position.

Rapid Transit Investment Act—1% tax on motor vehicles took effect Jan. 1st, 2008. No evidence that the project has begun. Tax does not sunset until project is completed. Needs gubernatorial and possibly legislative action ASAP.

Fluorescent Light Bulb Recycling Act—Seems fine.

Proposition on the Officialization of the Separation of Religion and State—Wording is pretty poor. Section II needs much more clarity to be effective.

Public Access to the Legislative Record Act—Why this is just sad. :(

Health Insurance Option Restoration Act—Seems fine. Only Section 1 is in effect.
1.   No state, county, municipality, or other political subdivision within the Northeast Region shall impose a tax penalty based on a resident's decision to not purchase privately offered health insurance.

Children’s Health Care Act—this may be obsolete with the creation of a public health care system by the Atlasian National Healthcare Act (https://uselectionatlas.org/AFEWIKI/index.php/Atlasian_National_Healthcare_Act)

Adoption Reform Act—It seems we have a DADT policy for gay adoption. I would change this as a matter of good policy.

Here are my recommendations so far:

Northeast Assembly Speaker Act needs concrete language to replace "as soon as possible" with reference to the haste with which the Assembly should elect a new Speaker to fill a vacancy. Violation of section 5 here presumably should incur some penalty.

SOLP Section 1 "Proposed Legislation Thread" subsections a and c have been repeatedly violated because they are unneccessary and impractical and should be repealed.
Section 2 "Movement of Legislation to the Northeast Assembly Floor" involves the Lieutenant Governor in the introduction of legislation to the floor of the Assembly. References to him should be replaced with references to the Speaker. Subsection a is verbose and requires clarification. A circular reference between subsections a, b and e must be removed or clarified.

The text of the NE Porn and Age of Consent Act (Dallasfan's section) needs to be corrected with amendments passed in 2009.

Tax laws and regulations seem to be in conflict with the Northeast March 2005 Tax Initiative, which repeals all sales and income taxes and replaces them with flat taxes. This may be obsolete and thus may need to be repealed.

The Northeastern Green Jobs Act does not define "green jobs", LOL.

The Northeast Natural Gas Leasing Act refers to a "Northeast Comptroller", a position which does not exist.

Section 2 of the Vacancy Filling Act is confusing, since a vacancy occuring on a Saturday both must occur on the next Friday and is prevented from doing so, since it is the sixth day after the vacancy:

The special election must take place no less than 5 days following the vacancy and the booth shall open at 12:00 AM EST on the nearest Friday, provided that Friday is at least 5 days since the vacancy occurred and shall close on that Sunday at 11:59 PM EST, to be administered by the appropriate official.


Also, the CJO is required to post candidates' names specifically in the the Candidate Declaration Thread. He should be informed of this.

The NE Order of Precedence Act needs to be revised or repealed, since former Governors come before Assemblymen in the order.

The Self Defense Act is vague and needs to be repealed or incorporated into the Constitution.

The Freedom to Drive Act refers to depletion in funds of the Regional Fund for Economic Recovery. Does anyone know if this institution has been functioning, or how much money is in it?

The Wiki Emergency Act requires a link to text of legislation: this is unnecessary and should be removed. Incorporation within the actual text of a wiki page is sufficient. Also, the Act allows the designation of a citizen to edit the wiki if the Lieutenant Governor cannot. Questions of enforcement arise here: altogether, this act should be considered for repeal or drastic rewording.

It was appropriated $14 million (or billion, who can remember) in early 2010, and the FDA was set to expire whenever the funds dried up.

Here is my copy of the report. Please review it and post any changes, amendments or clarifications you wish to be included in the final copy to be sent to the Assembly. However, if there are no objections/amendments, we will hold a vote on the report, and though we will need the endorsement of three commissioners, I'd prefer unanimity.

The Statutory Review Commission of the Northeast, having concluded its review of the statute, recommends the following changes to Northeast law:

1. Section IV of the Northeastern Healthcare Act is amended to include:

- The provisions of this act shall not be construed to limit the award of compensatory damages.

- The loser of the said lawsuit is hereby required to pay the legal fees of the winning party up to a reasonable maximum.

2. Article B, Section 2 of the Northeast Medical Savings Account Act is hereby repealed.

3. The Northeast Pornography and Age of Consent Act is amended to include:

1.  Section 3, Clause 1 is deleted and replaced with the following "All those persons of 16 years of age or older, not incarcerated for crimes, shall have the right to give consent to engage in sexual acts with other persons of 16 years of age or older."
2. "Any person of 21 years of age or older who engages in a sexual act with a person of 17 years or younger is guilty of statutory rape." is amended to read "Any person of 21 years of age or older who engages in a sexual act with a person younger than the age of 16 is guilty of statutory rape."

4. The Children's Healthcare Act is hereby repealed.

5. Sections 1, 2 and 3 of The Smoking Age Standardization Act are amended as follows:

SECTION 1.  Smoking age.  Except as provided in Section 3, no person under 18 years of age may do any of the following:
a. Buy or attempt to buy any cigarette or tobacco product.
b. Falsely represent his or her age for the purpose of receiving any cigarette or tobacco product.
c. Possess any cigarette or tobacco product.

SECTION 2.  Sale to persons under 18.  Except as provided in Section 3, no person may do any of the following:
a. Knowingly sell or otherwise distribute cigarettes to a person under the age of 18.
b. During the course of a sale of tobacco products, fail to perform a reasonable check of identification on persons appearing to be under the age of 28.

SECTION 3.  Exception.  A person under the age of 18 may purchase or possess cigarettes of tobacco products for the sole purpose of resale in the course of employment of a business registered under the tax code of the Northeast.


6. Section 4 of the Predatory Lending Prohibition Act is amended as follows:

SECTION 4.  Penalties.  The penalty for violation of any section of this act on the part of the lender shall be $10,000 per offense.

7. Section 1 of the Fair Property Valuation Act is hereby repealed.

8. The Northeast Speed Limit Standardization Act is hereby repealed.

9. The Northeast Region Legislation Standardization Act is hereby repealed.

10. The Preferential Voting Act is amended as follows:

Whereas preferential voting is more representative of the will of the voters than the current first-past-the-post plurality voting method used by the Northeast,

Be it resolved that future elections in the Northeast for Governor and Lieutenant Governor shall be done by preferential voting, wherein, if no candidate has a majority of first preference votes, the candidate with the fewest first preference votes is eliminated and his/her votes redistributed, until a candidate has reached a majority of votes or there is a tie between all remaining candidates, in which a case a run-off shall be held one week from the date of the opening of the polls in the regular election.

11. Subsections 1 and 2 of Section 1 of the The Campaigning for Invalidation of Votes Initiative are amended as follows:

1. It shall be a crime against the Northeast Region for any Northeast citizen to instruct or encourage a voter who has already cast his or her ballot in an election for a regional office to take an action that would have the effect of invalidating the ballot.
2. The above provision applies to any election for Northeast Governor or Lieutenant Governor, any vote on a Proposition, Initiative, Recall, Regional Constitutional Amendment or other regional referendum, election or plebiscite.

12. The Nullification Resolution is hereby repealed.

13. Section 2 of the Proposition on the Officialization of the Separation of Religion and State is amended as follows:

Quote
While education based upon religious law, dictates or dogma is hereby forbidden in all schools funded by the Regional government, any private educational institution not receiving funds from the Government shall not be subject to any controls regarding the religious nature of its curriculum.

14. Section 5 of the Northeast Assembly Speaker Act is amended as follows:

5. If the office of the Speaker becomes vacant for any reason, the Northeast Assembly shall elect a new Speaker from among its members by a majority vote of all members of the Northeast Assembly within three days of the vacancy arising, until which time no legislation may be brought to the floor.


15. Subsections a and c of Section 1 (Proposed Legislation Thread) of the Standing Order on Assembly Procedure are hereby repealed and subsection e of Section 2 (Movement of Legislation to the Northeast Assembly Floor) of the Standing Order on Assembly Procedure is hereby repealed.

16.  Section 2 (Movement of Legislation to the Northeast Assembly Floor) of the Standing Order on Assembly Procedure is amended to replace all references to the Lieutenant Governor with references to the Speaker of the Assembly.

17. Section 2 (Movement of Legislation to the Northeast Assembly Floor) of the Standing Order on Assembly Procedure is specifically amended as follows:

Except as provided in subsections (c) and (d), the Speaker shall place legislation from the Northeast Assembly proposed legislation thread on the Northeast Assembly floor (on behalf and stating the name of the sponsor) in chronological order, starting with the earliest piece of proposed legislation.

18. The Northeast Tax Initiative of March 2005 is hereby repealed.

19. The following amendment shall be made to the Northeastern Green Jobs Act:

Quote
5. A “green job”, for the purposes of this legislation, is defined as any full time employment in a business producing renewable energy, consumer or industrial products at least 50% more energy efficient than the market average, retrofits or installations intended to increase energy efficiency, or suppliers thereto.

20. The Self Defense Act is hereby repealed.

21. The Wiki Emergency Act is hereby repealed.

22. The Northeast Order of Precedence Act is amended as follows:

Quote
1. The Northeast Region shall use following order for ceremonial purposes:
a. Governor;
b. Lieutenant Governor;
c. Chief Judicial Officer;
d. Speaker of the Assembly;
e. Current Representatives by length of service

23. Section 2 of the Vacancy Filling Act is amended as follows:

Quote
2. The special election must take place on the nearest Friday falling on or after the third day following the vacancy. The booth for the special election shall open at 12:00 AM EST on that Friday and shall close on the following Sunday at 11:59 PM EST, and shall be administered by the appropriate official.


We, the undersigned commissioners, do hereby endorse these recommendations and urge the Assembly to adopt them forthwith.

The report of the SRC has been endorsed unanimously by the Commissioners. I will now present it to the Northeast Assembly.
