Post by: tmthforu94 on March 16, 2012, 11:52:43 AM
President Polnut has nominated Bgwah for a position on the Supreme Court of Atlasia.

72 hours for debate. Senators, you're welcome to question the nominee.

What is your view on the role of US Supreme Court rulings from prior to the formation of Atlasia? Are they binding? What about rulings from the era of the First Constitution?

* Puts on Groucho Marx glasses and sneaks into the Senate chamber pretending to be Senator Yankee*

Mr. Bgwah, if appointed to the SC, what do you plan to do about this? (https://uselectionatlas.org/FORUM/index.php?topic=78395.msg2777904#msg2777904) :)

I'd like to thank President Polnut for nominating me to this position.

I believe my long experience as Lt. Governor, Governor, President, Senator, and most importantly Attorney General have given me the necessary skills to more than adequately perform this function.

What is your view on the role of US Supreme Court rulings from prior to the formation of Atlasia? Are they binding? What about rulings from the era of the First Constitution?

I believe they carried over into Atlasia. New constitutions (and of course many new laws) have rendered many irrelevant, though. FTR, I haven't seen too many cases where this would have been important. A large majority of cases tend to be more Atlasia-specific (ie, our voting and registration laws, etc.)

I support you.

bgwah- I asked Fuzzy about this and I will be putting a billl forward to this end... when do you belive the DOJ has the right to overrule a regional or municipal law? What conditions do they need to meet to investigate- I am thinking of the NYPD mosque surveillance... what would lead you to side with the DOJ or with a region or municipality in a conflict like these?

I'm not familiar with the mosque case you cite, but I would look to the Constitution to make such determinations, specifically the following sections:

1) Article I, Section 7: Powers denied to the Regions (https://uselectionatlas.org/AFEWIKI/index.php/Article_I_of_the_Third_Constitution#Section_7:_Powers_denied_to_the_Regions)

2) Section 3: Supremacy Clause and Restriction on Federal Government (https://uselectionatlas.org/AFEWIKI/index.php/Article_IV_of_the_Third_Constitution#Section_3:_Supremacy_Clause_and_Restriction_on_Federal_Government)

Thank you- it is good to see you would turn to the Constitution... I did not realize the board had a separate one so I will have to read up on it. Despite the fact that some judges may try to legislate from the bench, I believe judges should be approved based on qualifications and not ideology.

You will have my vote

What is your position on the use of not necessarily Atlasian sources of law in alternative dispute resolution (not cases that reach trial or anything, but dispute resolution that might involve the participation of the legal system in some form, i.e. binding arbitration)?

Can you be more specific?

First of all, congratulations on your nomination, bgwah! :)

Based on my sole legal experience while on the Supreme Court, I'm curious as to your interpretation of the Campaigning for Invalidation of Votes Act (https://uselectionatlas.org/AFEWIKI/index.php/Campaigning_for_Invalidation_of_Votes_Act), specifically how broad the application is.

It seems like it could very well be interpreted as a violation of freedom of speech. Needless to say I'm not convinced it's constitutional.

For those not as familiar with your previous services, how impartial would a Justice bgwah be in lets say a case that included, either as the plantiff or the defendent, someone which you have currently or previously been on less than favorable terms?

How would you rate the quality of the administration of this hearing considering debate time expired three days ago?

You can blame Marokai for posting then running. ::)

Many of you should remember my tenure as PPT. I generally followed the rules pretty precisely, I think... :P
