Post by: Southern Senator North Carolina Yankee on April 17, 2012, 06:22:56 PM
Quote
Article 12: Expulsion Procedures
1. 1. A Senator may motion for the expulsion of any other sitting Senator, provided that the aforementioned Senator has not posted anything in the Senate for 14 consecutive days and has not declared a leave of absence before. This shall be done by creating a thread in the Atlas Fantasy Government Board specifically motioning for expulsion of the aforementioned Senator.

2. If the motion is seconded by another Senator, the PPT shall start another thread to debate and hear the reasons for the expulsion motion and provide an opportunity for the Senator being expelled to respond and defend himself. Debate on the expulsion for the Senator shall last for no less then 72 hours. Once 72 hours has expired, a Senator may motion for an extension of 48 hours to the debating period.

3. After all time has expire, the PPT shall close the debate and open a vote on the expulsion of the senator. The vote shall require, in accordance with Article 1 Section 3 Clause 1 of the Constitution, two thirds of the Senate to vote in the affirmative to expel the Senator. The vote shall last for 120 hours or until enough Senators have voted in the affirmative (7) or negative (4).

4. Following the expulsion of a Senator, the PPT shall inform the public of its actions and inform the Secretary of Federal Elections of the occurrence of a vacancy in the expelled Senator’s seat.

I am not motioning it till tomorrow, to be safe from a potential legal question that I think is bullsh**t, but losing one day to be safe isn't going to be that much of a problem.

I think this would be a good time to discuss our "expulsion philosophies".

There have only been a few times since its introduction that someone has been expelled. I have often been very considerate in its use. Were someone to return say on day 15 and explain some kind of "extra-ordinary" (as opposed to extroadinary, which implies outlandish), I would be willing to give them a benefit of a doubt and vote no on expulsion, depending on how convinced I am. However, with no return or explanation, my default is most certainly yes.

These have always been unanimous affairs (save for people who don't vote like the guy being expelled).

I'm certainly going to need some kind of an explanation before I make my final decision on this matter.  I like MoPolitico, but the game is in a desperate need of active players.

I think our legislators should actually legislate.

I second the motion

No motion has been offered at this time.

I would urge such to be refrained from until tomorrow afternoon.

Back in late 2010, BK passed the time frame for being AWOL. One of the many things that was claimed to save his seat was a bs way of counting days with regards to the OSPR. Rathern then fight it out and risk choas procedurally, we will wait till tomorrow afternoon.

At that time, if someone can motion for expulsion and then have someone else second it, that would be great.

Second.

I really didn't want to be the one to second, but I think it's important that we at least have a hearing so he'll be pressured to explain his inactivity.
