Postal Service Community Financial Lending Act of 2016

Introduction

In Atlasia today, there is a significant problem with predatory banks and payday loans with the effect of attempting to scam and destroy the lives of many low-income families. Estimates say that up to 15% of some families paychecks, which adds up to billions of dollars taken away from poorer families in fees and large interest rates.

 But there is a solution: Postal Banking is simply the provision of low-cost, consumer-driven financial services via the Postal Service. Products and services could range from check cashing to bill payment to savings accounts to small-dollar loans. Postal Banking will benefit consumers who do not have access to traditional banks as well as those who would prefer a more public option. Every other developed country in the world has postal banking. The expansion of services would also strengthen our public Postal Service, our lower income families, and therefore, our nation.


Section 1 - Empowering the Postal Service to Offer Basic Financial Services

The Atlasian Postal Service is hereby authorized and directed to offer the following basic financial services in each of its respective branches:
    i. small-dollar loans;
    ii. alone, or in partnership with depository institutions (as defined in federal statute) and credit unions:
        a. checking accounts and interest-bearing savings accounts; and
        b. services relating to international money transfers;
    iii. such other basic financial services as the Postal Service determines appropriate in the public interest; and
    iv. the creation of a "Postal Card" that allows users to engage in the financial services described under this paragraph.

Section 2 - Transaction Amounts and Regulations

There will be multiple provisions to ensure these financial services are fair and useful for those that need it:
     i. The small dollar loans will be capped at up to, or below $1,000, and must be given a set date until they will be paid back.
     ii. Their interest rates, for accounts and loans, will be adjusted and set by the Postmaster General.
     iii. Savings accounts can hold up to $30,000 per person, or $50,000 for a two person tax filing household.

Section 3 - Funding

1. This Government shall allocate 850 Million Dollars to the APS (Atlasian Postal Service) to set up this endeavor, which will after this, pay for itself by the year 2020.

2. The use of these funds shall be prioritized among the various post offices based on median income among residents holding PO Boxes at a given post office, with lower median income populations receiving higher priority.

3. Petitions may also be submitted by residents of municipalities to create postal banking options at their local post offices with signatures from at least 5% of the population of the municipality.

Section 4 - Effective Date

This Act shall take effect on the start of the 2018 Fiscal Year, on October 1st, 2017.

Section 1: A Path to Citizenship for Undocumented Immigrants
1. A conditional nonimmigrant visa shall be created which is valid for six years. This visa allows for legalized immigrants with work and travel authorization and protection from removal.
2. To qualify for the conditional nonimmigrant visa, an applicant must:
a) Establish they have been in the U.S. illegally before day of introduction of this bill.
b) Attest to having made contributions to the U.S. through employment, education, military service, or other volunteer/community service (with exemptions for minors, persons with disabilities, the elderly, or other unusual circumstances).
c) Pay an application fee of $75 and a $500 fine, and satisfy any applicable federal tax liability. The fine and tax liability may be paid upfront or over the course of an approved payment plan.
d) Not have any convictions for a felony or for three or more misdemeanors, or are presently being prosecuted for a felony charge.
3. Qualified conditional nonimmigrants and their spouses and children will be able to apply for lawful permanent resident status (green card) and eventual citizenship.
a) No green cards may be issued under this program earlier than six years after the date of enactment unless existing immigrant backlogs have been cleared before that time.
b) Conditional nonimmigrant visas may be renewed until such time as a green card is obtained.

Section 2: DREAM
1. Undocumented individuals who were brought to the U.S. before the age of 18 will apply for legal status through the same program outlined in Section 1 of this act.
2. These applicants will not have to pay fines.
3. There will be an accelerated path to legal permanent resident status upon graduation from high school, and completion of two years of college, military service, or employment (with exemptions for people with disabilities or other unusual circumstances).
4. Persons granted legal permanent resident status under this provision will be eligible for naturalization three years after the date the status is granted.

Section 3: Keeping Families Together
1. Immediate families of lawful permanent residents shall be reclassified as immediate relatives for immigration petitioning purposes.
2. Immediate relatives may continue to pursue their immigration petitions even if the U.S. citizen or permanent resident who petitioned for them dies or becomes incapacitated.
3. Immediate relatives shall be exempt from the annual cap on the number of immigrant visas per country per year.
4. Immigration judges may decline to order the removal of the parent of a U.S. citizen child if the judge, along with a guardian ad litem, determines that removal would not be in the child's best interests.

Section 4: Border Security and Enforcement
1. A Southern Border Security Task Force shall be created and composed of federal, state, and local law enforcement officers to protect Atlasia border cities and communities along the Atlasia-Mexico border.
2. $1,800,000,000, being paid for by the new visa program, shall be allocated for each of fiscal years 2017 through 2021 to make improvements to existing ports of entry in Atlasia to improve border security, to improve infrastructure for and implement the visa entry/exit verification program, and for training, oversight and evaluation for border agents.
3. The Department of Interior shall establish clear standards of professional conduct for all Customs and Border Protection agents within 100 miles of all land and marine borders.
4.  An employment verification system shall be created for employers to verify the work authorization of new hires based on taxpayer identification numbers for citizens, permanent residents, and immigrants on visas.
a) Once the verification system is in place, it shall be prohibited to knowingly hire unauthorized workers.
b) Employers found in violation of Section 4 - 4a will be assessed a $10,000 fee per violation.

Section 5: Addressing Root Causes of Illegal Immigration
1. Countries that account for at least 5% of unauthorized migration at the time of introduction of this bill to Atlasia shall be designated as priority recipients for foreign development assistance for the years of 2017-2021, with their status to be reevaluated by the Secretary of State after that time.
2. An additional 100,000 visas shall be created annually for immigrants from the above countries.
3. A "highest bidder" system will be set up so that whichever employer is willing to pay more for each individual visa will be given them. 50,000 will be given for "high-skilled" workers, and the other 50,000 for lower-skilled workers. This will bring in over $1 billion in new revenue.
4. At the discretion of the Secretary of the Interior, the above visas may be reduced by 10% for each 1% that the average yearly unemployment rate is above 5%.
5. Individuals awarded the above "high-skilled" work visas will be admitted to Atlasia as conditional residents and may petition for permanent resident status after their 3-year visa is up.  Likewise, for "low-skilled" workers, they may apply for permanent resident status after their 1-year visa is up.
5.6. An employer is allowed to refuse to renew an employee's work visa (if they do refuse, the employee must be notified at least 6 months before the visa expires), at which point, the employee (and their family) is able to apply for permanent resident status.

Section 6: Use of Funds Generated by this Act
1. Fees and fines generated by new programs within this bill will be used to assist state-based worker training programs, fund the employment verification system, fund border security and enforcement activities, and reduce visa backlogs.

  3. Every Atlasian military base will be visited by at least one member of the MBIC, who will write their own report.
  4. After every Atlasian military base has been visited by a member of the MBIC, the MBIC will meet for a session.
  5. At this session, the MBIC will determine, by simple majority vote, whether a base should continue to be ran or not.
  6. The budget of the MBIC will be $2,000,000.

II. Military Auditing
  1. A Military Audit Department (MAD) will be created, with the NPC Director of the MAD appointed by the Department of State.
  2. The MAD will be tasked with searching for and recommending eliminations of waste in the Atlasian military.
  3. The annual budget of the MAD will be $2,000,000.
III. Criteria
The MAD shall use the following criteria in determining the necessity for military bases:
  • Effectiveness in deterring terrorism and protecting Atlasian national security
  • Cost efficiency and management of base
  • Whether allies of the Republic of Atlasia feel that the base is essential to satisfying mutual security interests between them and the Republic of Atlasia, and whether the base is needed to fulfill a mutual defense agreement
  • How the presence of an Atlasian military base affects the nation's image and relationship with inhabitants of people living in the region where a base is located
  • Strategic and practical ramifications of closing a military base with regard to international reception

I still find it rather unnecessary to have 3 signatures before I sign, but ok.

But lets put it this way, it is easy to see if the PPT and Speaker are playing their role in a particular fashion. One of Goldwater's most important jobs is ensuring action "between" each house, without his signature there is no way for anyone to be able to see him doing that particular task except on the bills he administers himself.

Also your signature is normally outside the Quote box, whereas our three are inside of it and come after linked vote totals or a statement certifying joint passage in the case of Goldwater. :P

This Act recognizes the need to reform our outdated, costly and inadequate criminal justice system. For too long the federal government has been unwilling to take the necessary steps to challenge the long standing inequalities that exist in the Justice System.

Private Prisons

1.) The use of Federally ran private prisons is hereby ended in Atlasia. No new contracts shall be granted for private prisons, and existing private prisons shall be brought under control of the Justice Department.

2.) Private prisons that are managed by local, state and regional offices that keep continue to contract out prison services to private firms shall be faced with a levy of 10% on their yearly revenue.

Prison Education Expansion

1.) This act acknowledges that expanding educational opportunities, and job training for those incarcerated in prison greatly lowers their chance of re-offending, and puts them on the path for reintegration into society.

2.) This Act grants $500 million to develop educational facilities in Federal Prisons, to provide education, job training, and placing ex-convicts in paid positions with partnering companies.

3.) 30,000 Pell grants will be authorized in a pilot scheme to provide higher education to prisoners who will be completing their sentences within 5 years of beginning their degree.

Federal Prison Conditions and Standards

1.) No Juvenile prisoners shall be kept in Solidarity Confinement. Prisoners over the age of 18 shall only be kept in Solidarity Confinement for up to 21 days at any one time.

2.) $20 million is hereby set aside for a pilot scheme to create non violent wings of prisons, where prisoners who've been convicted of non-violent offensives shall be housed.

3.) $200 million is hereby allocated for mental health facilitates, training for staff and treatment for prisoners with mental health conditions.

4.) All prison staff should be trained in conflict resolution, and safe, and proper restraining techniques.

5.) If a prison does not have adequately secure facilities to house criminals with a history of dangerous and violent behavior apart from solitary confinement cells, they shall be transferred to a prison that does.

While I see the merits in this bill, I believe this is something the regions should handle. Therefore, I encourage either a reform to this bill or an outright cut of it to allow the regions to make their proper adjustments. I believe that minimum wage should be adjusted by area, 10$ is high enough nationally.

I can't back raising any taxes on our citizens. Isn't gas prices already high in most regions due to added environmental regulations?

I can't back raising any taxes on our citizens. Isn't gas prices already high in most regions due to added environmental regulations?
Hi friend, it's not so much about raising taxes as it is trying to rebuild our infrastructure system, I am personally hoping that we can reform our tax system to lighten the burden on our poor and middle class citizens, I believe that the policies in the days ahead will help to accomplish this as well.

Employees Rights Act
Section 1: Working Hours and Breaks
1. Employees, over the age of majority, shall work a maximum of forty-five (45) hours per week.
  a. Employees shall be able to opt out of this limit.
  b. Employees that are over the age of fourteen (14), but under the age of majority, shall work a maximum of thirty (30) hours per week.
  c. This limit shall be calculated as an average over the previous twelve (12) weeks.

1. Employees working full-time shall be entitled to a minimum of one (1) hour paid holiday for every fourteen (14) hours worked, in addition to public holidays.
2. Employees shall be paid their hourly rate, or hourly rate equivalent, for holiday.
  a. If the employee is paid based on a monthly salary, the hourly rate equivalent shall be the average monthly pay over the previous three (3) months divided by the average number of hours worked over the previous three (3) months.
3. Employees shall not be under any requirement to use their full allocation of holiday.
4. Employers shall are not required to carry holiday over to the next twelve month period or to pay employees an equivalent amount if they do not use all of their allocated holiday.

Section 3: Overtime
1. Overtime shall be defined as any time worked, in addition to contracted hours.
2. Any overtime that is compulsory for the employee to attend shall be listed in their contract.
  a. This overtime, on top of their standard hours, shall be exceed the number of hours listed in Section 1, Clause 1 of this act.
  b. The employee shall be paid their hourly wage, or hourly wage equivalent (as defined in Section 2, Clause 2a) plus a minimum 50% bonus for each overtime hour worked, for this overtime.
3. Any overtime that is voluntary for the employee shall not be subject to Section 3, Clause 2a or 2b.

Section 4: Part-Time Workers
1. Part-Time workers shall be defined as a person that works twenty-eight (28) or fewer hours per week.
2. Part-Time workers shall not be treated any less favourably by a company than Full-Time workers.
  a. Part-Time workers shall receive the same hourly wage as a Full-Time equivalent doing the same role.
  b. Part-Time workers shall not be excluded from training tasks or other benefits that are offered to Full-Time workers.
  c. Part-Time workers shall receive holidays in accordance to Section 2 of this act.

Section 5: Disabled Workers
1. Disabled Workers shall be treated equally within the workplace.
2. Employers shall do everything in their power to make a role available for disabled workers.
  a. Employers shall offer all disabled workers an interview for any role that they apply for.
  b. Employers shall make reasonable adjustments for disabled workers to ensure that they are not disadvantaged in the workplace.

Section 6: Monitoring of employees
1. Employers shall be allowed to monitor employees in the workplace.
2. Employers shall tell all employees about the monitoring process that take place in their workplace.
3. Monitoring of employees shall not be excessive and should be justifiable.
4. Information collected through monitoring shall be kept secure by the employer.
5. Ways the employers shall be allowed to monitor employees include, but are not limited to:
  a. Bag searches.
  b. CCTV.
  c. Monitoring of internet usage, email and telephone calls on equipment owned by the employer.
6. Employees shall be made aware of the locations of every CCTV camera in their premise.
7. Convert monitoring shall be allowed
  a. if the employee is under investigation, and
  b. if the employer has a suitable reason for the investigation.

Section 7: Self-employed workers
1. This act shall not apply to self-employed workers.

Section 8: Opt-outs
1. Companies or organizations ("groups") may apply to opt-out of this act.
2. These groups shall be approved by the Atlasian Department of Labor.
3. Federal and Regional Departments, the Security Services and the Military shall not be subject to these regulations.

Section 9: Implimentation
1. This act shall go into law immediately.

Columbus Day is hereby abolished as a Federal Holiday. Instead, on the date of October 9th, the Federal Government shall recognize the Indigenous Peoples of Atlasia through a yearly resolution honoring their contributions to the lands, and recognizing their unjust deaths at the hands of colonists.

All dates where Federal Elections are held are hereby established as Federal Holidays. Citizens are hereby granted the right to miss up to 4 (four) hours of a work day in order to vote. Employers shall not infringe upon this right by punishment of legal action taken by individual states or regions.

Section II. Enactment

I. This legislation shall be enacted immediately upon passage.

Support Victims of Mental Disorders Act

SECTION 1. PROTECTION

1. No business in Atlasia shall deny service to a legally competent person on the basis of their mental disorder.
2. Employees suffering from a mental disorder are protected from loss of employment due to their mental disorder as long as a certified psychologist or psychiatrist has not detected a general incapacity for work due to the mental disorder.
3. Students and pupils suffering from a mental disorder are protected from sanctions which penalizes misbehavior caused by their mental disorder.
3.1. An exception of this rule is an expulsion from school or college if a certified psychologist or has detected a general incapacity to visit the specific institution due to the student's or the pupil's mental disorder.
3.2. The evaluation whether the misbehavior is caused by a mental disorder or not has to be done by a certified psychologist or psychiatrist.

SECTION 2. ASSISTANCE

1. 9-1-1 emergency dispatch offices shall accept emergency calls concerning threats for suicide and suicidal thoughts. The calls shall be forwarded to an external emergency hotline.
2. The price for prescribed drugs against mental disorders shall never be higher than 2% of the patient's or, if underage, the patient's parents' monthly income.
3.
2. Assistance will be provided to the Regional Gov'ts for implementation and maintenance of Section 2.1, from the funds already allocated to the Substance Abuse & Mental Health Services agency, within the Department of Internal Affairs.            
          a. All such funding will be monitored and audited by the agency every six months
          b. Failure to comply with basically guidelines will result in the region losing said funding.

SECTION 3. INFORMATION

1. All high school students shall be informed at least once in their their school career about the most common mental disorders.
2. Non-profit-making associations that inform about mental illnesses shall have the right to request funding by the regional government.
3. During their education, teachers shall be prepared for the interaction with students suffering from a mental disorder.
4. The 21st of January shall hereby be declared as the “Mental Disorder Awareness Day.”

Today is 4/20, a day that can now be celebrated in Atlasia due to the fact that we have decriminalized weed. However, I am not satisfied with the progress we have made on the civil liberties front yet, I am instructing Attorney General Harry S Truman to make cocaine related crimes the lowest possible priority (which will essentially decriminalize it). I wish I could go further then just unofficially decriminalizing it, but it is not within my powers. I will be introducing a bill to decriminalize cocaine, and other drugs, soon to the Senate and/or House, regardless of which parties win this weekend's elections.

Family and Education Support Act

Section 1: Employer Information

1. In order for this bill's measures to be activated, the expectant mother or father, who is employed, must inform their employer of the pregnancy and the expected date of delivery.
2. The employer may not disseminate information about an employee's pregnancy to a third party without permission.

Section 2. Maternity Leave, Paternity Leave, and Parental Leave

1. The mother has the right to 14 weeks of maternity leave after the child's birth, where the employer shall pay at least the same rate as a 13-week wages average or of the last 3 months before pregnancy.
2. The father has the right to 2 weeks of paid paternity leave after the child's birth.
3. Either parent has the right to 3 years of unpaid parental leave.
4. Employees exercising their right for maternity, paternity, or parental leave are protected from loss of employment due to dismissal.
5. Employers with less than 10 total employees may claim a tax credit of no more than 50% of the value of the wages paid to workers taking paid maternity or paternity leave.

Section 3. Mother and Child Protection at the Workplace

1. Employers must protect a healthy and safe work environment for expecting and for nursing mothers.
2. Employers shall provide an adequate break room that can accommodate a reclining chair for expecting and nursing mothers who require it for their well being.
3. Expecting mothers are not permitted to perform heavy, physical labor or to work with or amongst materials, substances, and gases or in extreme elements, that could be deemed potentially hazardous to their health.
4. Expecting and nursing mothers are not permitted to work more than 8 1/2 hours daily or 90 hours in 2-week period.
5. Expecting and nursing mothers under 18 are not permitted to work more than 8 hours daily or 80 hours in a 2-week period.

Section 4: Protection Period

1. Employees may claim parental leave days at any point after the pregnancy is confirmed to an expectant mother. Those who claim days prior to the birth of the child shall be required to give a valid medical reason as to why, signed off on by a medical doctor, for the purposes of validation.

Section 5: Paid Educational Leave

1. Employees having been with an employer for at least 1,040 days shall have the right of paid educational leave for a period of up to three years.
2. Paid educational leave is hereby defined as leave that furthers the education of a worker in question. The education must be relevant to their current profession or line of work. Workers shall be able to claim full pay for hours lost as a result of education courses, provided that the worker in question has been with an employer no less than 1,040 days, gives the employer advance notification of the absence of no less than 30 days prior, and provided that the absence in question takes place during the regular working hours of the employee in question.  Employers may require workers to provide a copy of their schedule for verification purposes.
3. In addition, any educational leave that is sponsored by or required by an employer shall be paid, regardless of how long the employee in question has been with the employer.

AN ACT
to establish the criminal code
of the Republic of Atlasia

Section 1 (Title)
i. The long title of this Act shall be, the Criminal Justice Act of 2016. It may be cited as the Criminal Justice Act or as the CJA.

Section 2 (Crimes against Atlasia)
i. The following shall be crimes against Atlasia:
(a) Impersonation. This offense shall be defined as the impersonation of another Atlas Forum member, be they a citizen of the Republic of Atlasia or not, within the territory of the Republic of Atlasia.
(b) Identity Theft. This offence shall be defined as the illicit taking of control by any means of another Atlas Forum member's person account, be they a citizen of the republic or not, without explicit and provable consent.
(c) Voter Fraud. This offence shall be defined as the creation of identities other than a citizen's primary identity in the Republic of Atlasia and subsequently entering this identity into the tally of registered voters.
1. If a citizen no longer has access to their previous forum account and wishes to register with a new forum account in Atlasia, then they shall be allowed to do so legally only if they make it clear in the registration thread who they are and which forum account they previously registered under so that the Secretary of Federal Elections may appropriately update the registration without having any duplicate accounts on the voter roll.
2. This shall exclude those who have had their previous account banned from the Atlas Forum.
(d) Electoral Fraud. This offence shall be defined as the manipulation of of the republic's electoral procedures and practices with the aim of fraudulently altering the results of a specific electoral contest.
(e) Obscenity. This offence shall be defined as the posting of any threads, messages, images, videos, links or other media of a pornographic or sexually explicit nature on the territory of the Republic of Atlasia. In cases where the material posted is of a clearly pornographic nature, the offence shall be known as Gross Obscenity.
(f) Electoral Intimidation. This offence shall be defined as the placing of undue pressure on a citizen of the Republic to cast a ballot in a particular way, to not cast a ballot at all, or to invalidate a ballot already cast via direct threats of revenge, blackmail, or retribution. In those cases in which undue pressure has been applied in the form of credible threats to disclose personal information, the offence shall be known as Grievous Electoral Intimidation.

(g) Ballot Tampering. This offence shall be defined as the deletion of a ballot during a period between vote was closed and elected officeholders sworn-in or soliciting to delete a ballot during the same period.
(h) Misconduct in Public Office. This offence shall be defined as the abuse of office for provable personal gain by cabinet officials or deputy cabinet officials.
(i) Perjury. This offence shall be defined as "any person who takes an oath before a competent tribunal or officer that he will testify, declare, depose, or certify truly, or that any written testimony, declaration, deposition, or certificate by him subscribed, is true, wilfully and contrary to such oath states or subscribes any material matter which he does not believe to be true."
(j) Breach of the Peace. This offence shall be defined as the wilful undertaking of activities that though not treasonous nevertheless undermine the stability and security of the Republic of Atlasia.
(k) Malicious Editing of the Wiki. This offence shall be defined as the editing of the Atlasia Wiki with malicious intent.
(l) Improper Behaviour on the Wiki. This offence shall be defined as the knowing violation or flagrant disregard of standards and guidelines for the Atlasia Wiki established by the National Archivist.
(m) Contempt of Court. See Section 5, clause iii of this Act.
(n) Terrorism. This offense shall be defined as the malacious deletion or destruction of threads housing government institutions, voting booths, or the legislation threads of any legislative body in Atlasia.
ii. In those cases in which a Crime Against Atlasia has been attempted unsuccessfully, it shall nevertheless be possible to charge a citizen with the offense that they unsuccessfully attempted to commit. In such cases the official record of the charge shall be prefaced with 'Attempted', but no other alterations to procedure shall be made. This applies to all Crimes Against Atlasia with the exception of Obscenity (including Gross Obscenity), Misconduct in Public Office, Perjury, and Contempt of Court.
iii. In those cases in which the perpetrator of a Crime Against Atlasia has been instructed, commissioned, mandated, or otherwise aided by other persons in the planning or execution of the offence in question, then those persons may also be charged with the offence that they conspired to commit. In such cases the record of the charge shall be prefaced with Conspiracy to Commit, but no other alterations to procedure shall be made. It shall not be necessary to charge an individual with a specific Crime Against Atlasia in order to charge other persons in this manner.

Section 3 (Treason)
i. The following acts are hereby declared to be treasonous:
(a) Rebellion. This shall be defined as the use of armed forces to overthrow the government of Republic of Atlasia or the government of any of its constituent Regions.
(b) Aiding Rebellion. This shall be defined as the intentional direction of funds, military aid, or strategic advice to any person, persons, group or groups engaged in or seeking to engage in rebellion against the government of the Republic of Atlasia or the government of any of its constituent Regions.
(c) Terrorism. This shall be defined as the use or threat of use of force or violence by a person, persons or organized group against people or property with the intention of intimidating civilians and/or the government of the Republic of Atlasia or the government of any of its constituent Regions.
(d) Destruction of a Voting Booth. This shall be defined as the deleting of the thread in which a voting booth or an absentee voting booth for an active election is contained.
(e) Destruction of Public Records.  This shall be defined as the deleting of a thread in which legislation or executive actions are contained.
(f) Secession. This shall be defined as the declaration or threatened declaration of independence from the Republic of Atlasia by any territorial entity within the bounds of the Republic of Atlasia or by any group of persons within the bounds of the Republic of Atlasia, except according to the provisions set forth in the Constitution thereof.
(g) Refutation of Federal Supremacy in Law. This shall be defined as the denial – whether by word, by deed, or by omission – by any serving officeholder in the Republic of Atlasia or any of its constituent Regions of the supremacy of federal law, or of the decision by any person to serve in a Regional government that denies that it is subject to federal law.

i. In order for a criminal conviction in the Republic of Atlasia to stand it is necessary that the case against a defendant or against multiple defendants be proven beyond all reasonable doubt.
ii. The basic standard of liability for cases concerning both Crimes Against Atlasia and Acts of Treason shall be as in the Common Law: actus reas non facit reum nisi mens sit rea. It must therefore be proven not only that a criminal act has taken place but that the citizen charged can be reasonably held to be fully responsible, whether by act or by omission, for that criminal act.
iii. In cases in which it is certain that a criminal act has been committed by a member of a group of persons, but that it is not certain which of those persons has committed the criminal act, then it shall be possible to convict all said group of persons of the criminal charge in question, provided it can be demonstrated that there was no attempt by that group of persons to prevent the criminal act from taking place.

Section 5 (Criminal Prosecution)
i. Trial of all Crimes against Atlasia and Acts of Treason shall be performed in full compliance with the provisions of Article I of the Fourth Constitution of the Republic of Atlasia. Breach of these provisions shall render any conviction unsafe.
ii. Defendants shall not be denied access to legal counsel from an active citizen of their choice, and also retain the right to waive their right to legal counsel. If a defendant has attempted without success to secure legal counsel or has, after a period of more than forty eight hours, declined to either seek or affirmatively waive legal representation, then the Department of Justice shall nominate an appropriately qualified citizen to act as Public Defendant for the duration of the trial. Said nominee must meet with the approval of the Presiding Judge in the trial in question and must be a person of upstanding moral character.
iii. The Judiciary is hereby mandated to create and to uphold all rules with respect to trial procedure, up to and including the matter of personal conduct, so long as these rules do not contradict any part of this Act. In the event of a gross breach of trial procedure, the Presiding Judge may choose to charge the person or persons responsible with Contempt of Court which shall be treated as a Crime against Atlasia as per Section 2, clause i of this Act.

Section 6 (Admissibility of Evidence)
i. The Presiding Judge may admit the following as evidence at his own discretion:
(a) Any actual statements, whether quoted in full or in part, made on the Atlas Forum that pertain to the trial. If these statements have been deleted from the Atlas Forum but a copy in the form of a screenshot has been made of them, then that copy in the form of a screenshot may be treated as equally admissible to an original quoted statement. If these statements have been deleted from the Atlas Forum, but survive – whether in full or in part – as quotations in the post of another Atlas Forum user, then these quoted fragments may also be treated as equally admissible to an original quoted statement.
(b) The sworn testimony of a citizen of the Republic of Atlasia who has witnessed the alleged offence or its planning or preparation at first hand, or who has witnessed credible evidence of conspiracy.
(c) An admission of guilt or culpability by the defendant in a thread on the Atlas Forum, or in a place viewed or heard by other persons, with recordings or testimony attributing to the same.
(d) Evidence obtained through proper investigation of the IP address from which the offence was perpetrated.
(e) Credible evidence presented to the Court by the Forum Moderators or by Dave Leip, the Forum Owner.
(f) Other forms of evidence that are credible in nature and which do not contradict this Act or the Constitution of the Republic of Atlasia may additionally be considered.
ii. The Presiding Judge has an absolute right to reject evidence (whether in whole or in part) that he or she feels to be tainted by procedural flaws, to be of dubious provenance or to wholly lack credibility.

Section 7 (Sentencing)
i. In the event of a conviction, sentencing shall be carried out by the Presiding Judge in accordance with the following guidelines:
(a) The standard punishment for both Crimes Against Atlasia and Acts of Treason shall be the removal of certain political rights – the right to hold office and the right to vote in federal or regional elections – of the guilty person or persons. The Presiding Judge may decide at his or her discretion on the exact combination of political rights to remove from the guilty person or persons. Subsequent references to sentence length refer to any and all combination of the above punishments.
(b) For all Crimes Against Atlasia and even for Acts of Treason there shall be no minimum sentence. In such exceptional cases as the Presiding Judge sees fit, he or she may opt to issue a Discharge, which shall mean that the guilty person or persons shall suffer no punishment further than the acquisition of a criminal record.
(c) The maximum sentence for all Crimes Against Atlasia other than Identity Theft or Electoral Intimidation shall be of one year in length.
(d) The maximum sentence for Identity Theft and Electoral Intimidation shall be of two year in length.
(e) The maximum sentence for all Acts of Treason and Terrorism shall be of three years in length.

The signatures is more of a certification, coupled with links to the vote. This way both houses have access to the other houses' debate and vote and thus avoid confusion over whether or not a bill had passed the other chamber, which has been a pretty significant problem prior to this congress. In fact most of the confusion regarding bills this congress dealt with those bills that passed in one of the chambers in the 4th or even a prior Congress like the Freedom to Drink Act and thus before this system was introduced.

It also helps us see that all three Congressional leaders are performing their Constitutional duties, especially the Vice President, where in the absence of a signature, it would just get slotted to the President and there would be no way for people to see the activity occurring in his very important role in managing bills between houses and between the Congress and the President.

It is possible that this one just got overlooked, because I include Goldwater in most all of my PMs to House members and I know communications between PiT and myself are also sent to Goldwater, so it is likely that it is just buried in that. It is a new system just introduced in the 5th Congress and so a few glitches is to be expected.

However, when you consider the fact that the previous 4th Congress only put two bills on my desk as President and as President Dfw received about a dozen from the 5th Congress, I think both the competence of the leaders involved and the soundness of the system generally, has been proven. I think the 5th is the most efficient and effective of all the Congresses so far and that is largely do to improvements in the noticeboards, and the presence of these "links certified with signatures".

3. Non-profit organizations focused on ending hunger within Atlasia shall be given priority, followed by animal feed, compost for agriculture, and energy use.
4. Food that is no longer edible shall be recycled.
5. Food markets with less than five locations that wish to participate in this program shall be eligible for a $5,000 tax credit for their annual participation.

Section 3: Prohibition of Food Waste
1. It is hereby prohibited for food markets to dispose of unused edible food above a threshold to be set by the Agency of Food Conservation.
2. Unused edible food is defined as products approaching the expiration date that markets no longer intend to keep on shelves to sell.
2. Food markets with less than 5 locations shall be exempt from this prohibition.
3. Deliberately wasting food above the given threshold or spoiling food shall be punished by a fine of $10,000 per violation.
4. This shall not apply to food unfit for consumption.

Section 4: Food at School
1. School cafeterias are hereby prohibited from forcing students to take any food he or she does not want when buying breakfast or lunch.
2. Food that is left over and fit for consumption shall be donated to a local food bank.

Section 5: Prohibition on "lunch-shaming"
1. Schools are hereby prohibited from publicly disciplining students that are unable to afford lunch on a given day, including but not limited to requiring the student to wear a sign or stampage indicating his or her inability to pay, or requiring the student to fulfill custodial tasks.
2. Students that are unable to afford a school lunch shall receive a letter of notification informing his or her parents of the student's lack of ability to pay.

As of this moment, I only recognize three regions, the Southern region, the Region of Fremont, and the Region of Lincoln. I do not recognize the State of Texas as it's own region. Should the citizens of Texas still want to establish their own region, it is my understanding that this is the process that they must follow:

Amendments to the Constitution must be introduced to either the House or the Senate, the Amendment must then be passed by 2/3 of both House of Congress. Then, the Amendment must be passed by at least 2 out of the 3 regions by popular vote. Only then will the Federal Government of Atlasia recognize Texas as its own Region within Atlasia. As of now the Federal Government of Atlasia recognizes Texas as a part of the Southern Region of Atlasia.

2. Insurance entity - Any entity that offers to protect against a financial loss, in exchange for an ongoing financial payment.
3. Securities entity - any entity engaging in the issue, flotation, underwriting, public sale, or distribution of stocks, bonds, debentures, notes, or other securities; activities of a broker or dealer, futures merchant, or investment adviser; hedge fund or private equity investments. 
4. Swap entity - includes swap dealer or swap participant.
5. Hedge Fund - a limited partnership of investors that engages in high risks security and investment activities, using borrowed money.

Section II: Separating Financial Entities
1. No depository entity may become affiliated with or in common ownership with any insurance company, securities entity, swap entity, or hedge fund.
2. No depository entity may engage in the activities of an insurance company, securities entity, swap entity or hedge fund.
3. No Person employed in such capacities for the above entities listed in clause 2 of Section II, shall be employed on the board of a depository agency.
3. No depository entity may acquire or sell a structured or synthetic financial product composed of other securities, swaps, assets or index of assets.

Section III: Enforcement
1. Failure to comply with the terms of this act will result in a fine of 10% of net profits for 10 years, and the termination of activities in violation.
2. Existing companies that engage in activities that violate the terms of Section II, will have 2 years to transition to state of compliance, a process that will be overseen by the Securities and Exchange Commission and the Federal Deposit Insurance Corporation (FDIC).
3. Such Existing Companies may request six month extensions from above agencies if the Federal Reserve Board of Governors certifies that such extension is in the public interest, but no company will receive an extension greater than one year.

Airline passengers have filed more than 30,000 claims of missing valuables between 2010 and 2014;
The TSA is an overall ineffective and expensive agency, draining public funds to the tune of $7.3 billion per year

SECTION 3. ABOLISHMENT OF TRANSPORTATION SECURITY ADMINISTRATION

No federal funds shall be appropriated to maintaining the TSA upon conclusion of fiscal year 2018, whereafter it shall no longer be established as a federal agency under the Department of Homeland Security.

SECTION 4. AIRPORT SECURITY GRANTS

Funding that would otherwise be appropriated for the establishment of the TSA shall be distributed annually to all public and private airports within the Republic of Atlasia.  Grants may be approved for all security-related expenditures including but not limited to purchase and maintenance of metal detectors, X-ray machines, and security personnel.

SECTION 5. PRIVACY AND PASSENGER RIGHTS

1. Airline passengers must be informed of the location of personal belongings and guaranteed complete access to these items following the de-boarding process.  All airports in the Republic of Atlasia shall assume full responsibility for the proper handling of lawfully permitted items.

2. No member of security personnel may caress or 'pat down' airline passengers who are not under suspicion of wrongdoing.

III. - Use Of Technologies: The Internal Revenue Service is encouraged to utilize modern technologies such as electronic mail and the Internet to minimize the cost of sending Federal tax receipts to taxpayers. The Internal Revenue Service shall establish an interactive program on its Internet Web site to allow taxpayers to generate Federal tax receipts on their own.


SEC. 3. EFFECTIVE DATE.

This act shall apply to taxable years beginning after the date of the enactment of this Act.

I will be in constant communication with the Prime Minister of France and the new President to ensure that everything is done to help bring to justice whoever was behind this act. Replacing Lead Service Lines - Direct grants shall be awarded to the city of Flint for any activities deemed necessary by the Atlasian Environmental Protection Agency to ensure that the city of Flint’s drinking water does not contain high lead levels. This includes repair and/or replacement of public and private water service lines, inspection of public and/or private water service lines, and corrosion control programs to optimization public and/or private water service lines.

Loan Forgiveness - Eliminates the current cap of 20% of state Drinking Water State Revolving Funds (DWSRF) that can be used on loan forgiveness and allows the state of Michigan region of Lincoln to forgive existing DWSRF loans made to the city of Flint

Wrap-Around Services for Flint Families and Children Exposed to Lead - $235 million ($470 million total with region match)

Atlasian Department of Health and Human Services - $135 million ($270 million total with region match):

- $125 million for Head Start and Early Start for Flint children exposed to lead
- $5 million for school based health centers in all Flint schools
- $5 million for mental health services for Flint families and children dealing with lead exposure

Atlasian Department of Education - $90 million ($180 million total with region match):

- $25 million for reduced class sizes, hire additional school personnel, and fund improvements to Flint school buildings;
- $25 million for city-wide after-school programs for Flint children exposed to lead
- $25 million for expanded PELL Grants to support additional college access for Flint youth
- $5 million for special education services
- $5 million for career and technical education
- $5 million to create a ‘Promise Neighborhood’ program in Flint (provides funding to support eligible entities, including (1) nonprofit organizations, which may include faith-based nonprofit organizations, (2) institutions of higher education, and (3) Indian tribes)

Atlasian Department of Agriculture - The Secretary of the Interior shall allow the Agriculture Department to expand Women, Infants and Children (WIC) program to areas where a federal state of emergency has been declared.

Atlasian Department of Housing and Urban Development - $5 million ($10 million total with region match):

- $5 million for lead prevention programs

Atlasian Department of Justice - $5 million ($10 million total with region match):

- $5 million for juvenile delinquency prevention programs

Economic Development - $45 million ($90 million total with region match):

Atlasian Department of Labor - $20 million ($40 million total with region match):

SECTION 2. PHARMACEUTICAL REPORTING REQUIREMENTS
a. All manufacturers of pharmaceutical drugs and biological products approved by the Food and Drug Administration shall submit to the Secretary of Internal Affairs an annual report outlining, with respect to each drug:
   i. The total expenditures of the manufacturer, including an itemized description of domestic and foreign drug research and development, a description of the cost of goods sold broken out by source and cost of each component, acquisition costs in total and per unit sold (including costs for the purchase of patents and licensing), and a breakdown of the cost of marketing and advertising.
   ii. The gross and net revenue and the gross and net profit of the manufacturer.
   iii. The total number of units sold in the previous calendar year.
   iv. Pricing information, including the cost of wholesale acquisition, the net average price realized by pharmacy benefit managers, and the net price of the drug charged to purchasers in each OECD nation where the drug is sold.
   v. Any federal benefits received by the manufacturer, including the amounts and periods of impact for each such benefit.
   vi. A description of patient assistance programs offered, sponsored by, or associated with the manufacturer, including a discussion of the specific forms of such patient assistance available, the dollar value of each program per patient and in total, the average duration of such programs, the number of individuals participating in such programs, and complete documentation of the terms and conditions of participation in such programs.
   vii. The percentage of research and development expenditures conducted by the manufacturer, as well as the percentage of such expenditures conducted by federal entities, and the percentage conducted by other entities (such as academic institutions or other manufacturers)
b. All manufacturers of pharmaceutical drugs and biological products approved by the Food and Drug Administration shall include in this report executive compensation for the chief executive officer, chief financial officer, and the three other most highly compensated officers, including bonuses and stock options.
c. These reports shall be submitted by the Secretary to the Congress, and made publicly available in a searchable online format.
d. Any manufacturer that fails to submit a complete report required under this section shall be subject to a civil penalty of up to $200,000 for each day on which the violation continues.

Individuals shall be permitted to sell firearms if they own a state license permitting them to do so, which shall include the cardholder's full name, gender, photograph, identification number, and state and city of residence.  Unlicensed firearm sales between non-family, as well as unlicensed sales which take place either online or at firearm shows and fairs, shall be prohibited.

Forest Revitalization and Preservation Act

Section 1: High Priority Reforestation Areas

1. The National Forest Service, under the purview of the Department of Interior, shall identify and focus reforestation efforts on high priority areas in areas of national forests with higher rates of decline.
2. These efforts shall attempt to preserve biodiversity to the fullest extent possible.

Section 2. Research and Development

1. $10 Million shall be allocated for the research and development of methods to best preserve our national forests.  This research shall focus on the following areas:
a) Ensuring reforestation efforts take historical biodiversity and habitats into account.
b) Dealing with invasive species such as bark beetles and emerald ash borers.
c) Best practices for seed distribution in different types of habitats.
d) Best practices for reducing the risk of wildfires.

Section 3. Funds for Regional Reforestation Efforts
1. A federal fund shall be created to encourage the development of regional reforestation efforts which shall match the the allocated funds for regional reforestation programs that encourage the replanting of trees or provide subsidies for tree farms that grow their own trees.
2. Regional governments shall apply to the Department of Interior by submitting their reforestation plans to the Department of Interior for approval.

Section 4. Bar on mountaintop removal surface mining

1. The Atlasian government shall not distribute any permits to coal-mining industries whose practices would result in the topographical alteration and/or removal of a summit, summit ridge, or significant portion of a mountain, hill, or ridge.
2. Mining industries that partake in this practice may be fined at an amount not exceeding $2,000,000. The final amount shall be determined in a court of law.

Everybody, I have enjoyed being President very much, I have not been able to do nearly as much as I had hoped in my Presidency, but we have gotten some good things done. However, as of late, particularly since I swore in for my 2nd term, I have become inactive and have not written a single bill. While I have signed all of the bills that have landed on my desk, I believe this is not enough. I am resigning from the Presidency tomorrow evening, at 8 PM Eastern / 7 PM Central. I hope that my future predecessors can be much more active than me, because Atlasia deserves someone who is more active than myself at this time. I am glad that healthcare reform, which is something that personally impacts me deeply in real life, will be the final bill for me to sign. Thank you and I appreciate everything the federalists and those who have voted for me since I first joined the game have done for me.

Part I: Health Care Marketplace

Section 1: Regionalization


1. All present healthcare exchanges are abolished as of January 1, 2018.

2. Three new exchanges will be created and administered by the Health & Human Services (H&HS) Sub-Department, within the Department of Internal Affairs, with jurisdictions matching those of the three Regions. The H&HS Sub-Department will coordinate with regional officials during the setup and implementation process, and hand over administration and regulation of the new exchanges on January 1, 2018, to the respective Regional Government

3. All Federal restrictions on the access to these markets will be abolished as of January 1, 2018, including but not limited to the sale of insurance across regional lines.

4. On that date, the Regions will become the primary regulator of access onto their market and responsible for determining the nature and structure of healthcare providers allowed onto the exchange to compete, provided all terms of this act and federal law are complied with.

5. Should a region’s legislature fail to act by the above date, the H&HS Sub-Department will continue to administer the exchange until such time as the Regional Government is able to assume control.

Section 2: Coverage
1. Minimum Coverage Requirements


a. Preventative Care: Every exchange must offer at least one provider that covers preventative care, be it in the form of a private insurer, co-op or public health care benefit. Preventive care shall be defined as care related to disease prevention, early diagnosis and health maintenance, including clinical examinations, immunization, prenatal care and medically indicated screenings.

b. Each exchange will be required to have at least one provider that covers catastrophic and emergency room care.

c. AtlasCare must be available to all populations mentioned in Part III of this Act.

d. All other mandates on either citizens or healthcare providers will be the responsibility of the regions.

2. Health Care Savings Accounts

a. Individuals and Households may establish Healthcare Savings Accounts (HSA) with unlimited tax free contributions. Employers may also set up these accounts for their employees, with any matching contributions also tax free.

b. The money in these HSAs must be used for healthcare and healthcare related expenditures. No prohibitions will exist on the use of this money for any healthcare or healthcare related expense, including insurance premiums. The money will also be carried over from year to year.

c. The money in these accounts will be invested as a reasonable, sustainable rate of growth and insured in its full amount, by the Federal Government, under the FDIC.

d. All contributions by an individual to their HSA, made during the course of the year will be tax deductible.

3. Subsidized Health Care Coverage

a. Healthcare Insurance will be subsidized in accordance with a sliding scale subsidy based on age and income in relation to a maximum of $12,000 annually, indexed to Health care inflation.

b. The formula is as follows: y = 1 - (x - f(t))/2

 where x is the multiple of $12,000 that their annual salary amounts to and f(t) is the formula for determining the max subsidy cutoff as a function of age t. (f(t) = 0.0022*(t-20)^2 - 0.0291*(t-20) +1.66))

c. The formula will be applied towards the premiums, co-pays and deductibles of  qualifying providers, as determined by those who comply with all provisions of Federal and applying regional regulations, on the exchanges, as established in Section 1.

d. Anyone who doesn’t have a qualifying insurance program for any period of time, will have the subsidy distributed to a Health Savings Account, as established in Section 2, Part 1, subject to further regulation by the regions.

e. The subsidy will be paid for using the existing revenues for the Affordable Care Act, Medicaid and Medicare. The Medicare Payroll Tax will be renamed the Health Care Payroll Tax and increased from 1.45% to 2.50% on employees and employers, for a total of 5%.  

f. The subsidy shall be administered with the H&HS Sub-Department by the newly created Healthcare Subsidy Office (HSO).

4. Prescription Drug Out-of-Pocket Monthly Cap

a. Each family or individual who legally resides in the Republic of Atlasia shall receive a tax credit for full compensation of any monthly amount for which prescription drugs exceeded $250 in out-of-pocket costs.

b. These tax credits will be paid for using the existing revenues for the Affordable Care Act, Medicaid, and Medicare.

Part II: AtlasCare

Section 1: Relationship with the Exchanges

1. AtlasCare shall be a federally administered, market competing public health insurance option, operated by the newly created AtlasCare Office (ACO) within sub-department of H&HS, within the Department of Internal Affairs.

2. AtlasCare shall be automatically provided in all of the Regional Exchanges unless a region opts out of AtlasCare for their Exchange, in which case the mandates in Part I, Section 2.1, shall apply in full to ensure that care remains available, as well as an option for subsidy recipients. AtlasCare will also be available in all regions as an option for active duty military, veteran healthcare and senior healthcare, and the other special groups as detailed in Part III, regardless of a regional opt-out.

3. If at any point a region, which had previously opted out of AtlasCare, fails to provide the regulated options as established in Part 1, Section 2.1, all citizens will be eligible to enroll in AtlasCare until such time as compliance may be obtained.

4. The AtlasCare administration will be tasked with acquiring the most extensive provider network possible while maintaining high quality standards and remaining cost competitive on the Regional Healthcare Exchanges relative to the cost of other providers. It may establish quality standards to ensure the protection of its insured populations.  The AtlasCare administration is authorized to negotiate with all medical suppliers and providers to secure lower prices, including but not limited to prescription drug companies.

Section 2: Components of AtlasCare
1. Eligibility and Benefits


a. All Atlasian citizens are eligible for coverage under AtlasCare, entitling them to public, quality standard of care.

b. The health care benefits under AtlasCare cover all medically necessary services, including at least the following:

  • Primary care and prevention.
  • Inpatient care.
  • Outpatient care.
  • Emergency care.
  • Prescription drugs.
  • Durable medical equipment.
  • Long-term care.
  • Palliative care.
  • Mental health services.
  • The full scope of dental services (other than cosmetic dentistry).
  • Substance abuse treatment services.
  • Chiropractic services.
  • Basic vision care and vision correction (other than laser vision correction for cosmetic purposes).
  • Hearing services, including coverage of hearing aids.
  • Podiatric care.
  • Contraceptive services.
  • End of Life Care - Shall be limited in hospital settings up to the cost of such care when attained through a hospice setting.

2. Parts of AtlasCare

a. Benefits covered by AtlasCare plans shall be purchased individually, with recipients being covered under the following parts:

AtlasCare Part A provides benefits and coverage for

  • Inpatient hospital stays and care
  • Hospice and home health services

AtlasCare Part B provides benefits and coverage for

  • Doctor and clinical lab services
  • Outpatient and preventive care
  • Screenings, surgical fees and supplies
  • Physical and occupational therapy

b. AtlasCare Part C provides benefits and coverage for all services covered under AtlasCare parts A and B.  Recipients must apply for Parts A and B in order to qualify.

c. AtlasCare Part D provides coverage for prescription drugs.  Every AtlasCare Prescription Drug Plan has a formulary that lists drugs covered by the plan.  Only those enrolled in at least one of AtlasCare Part A or AtlasCare Part B may qualify for prescription drug benefits.

The Department shall work with its subordinates and regional authorities to ensure coordination and ensure that there are no lapses in services for the recipients of Medicare, Medicaid and similar programs.

5. Once the transition has been completed, the Department of Internal Affairs, shall direct for the elimination of unnecessary administrations, offices, and sub departments that are no longer required subsequent to this transition.

Section 2: Coverage for Special Populations

1. All active duty military personnel shall be eligible for full coverage under AtlasCare, fully paid for by the Defense Health Agency, of the Sub-Department of Defense, within the Department of State, with no premiums, co-pays or deductibles.

2. All Veterans shall be eligible for full coverage under AtlasCare, with no co-pays or deductibles, with subsidies for premiums as described in Part 1, Section 3 of this Act.  Cost normally associated with co-pays and deductibles shall be covered by the government through the Veterans Benefits Administration.
  
3. A “veteran” is defined for the purpose of this section as any person who served on active duty in the armed forces of Atlasia and received an honorable or general discharge.

4. Upon the completion of this transition of Veterans and Activity Duty Military to the Atlas Care program, with AtlasCare expenses covered by the VBA and Defense Health Administration, the Department of State shall subsequently review and direct the elimination of unnecessary administrations, offices and sub-departments that are no longer required subsequent to the transition.

Section 3: Pre-existing Conditions and High Risk Populations

1. A Comprehensive Insurance Equality Pool (CIEP) shall be established within AtlasCare so that those with pre-existing conditions can receive affordable care without discrimination.  Those with pre-existing conditions or other factors such as age or gender which may increase risk to health or risk of health related cost shall be covered under AtlasCare at the same cost to the consumer as those without these conditions.

2. The CIEP shall be subsidized out of funds derived from the same revenue provided for the health subsidy in Part I, Section 2.3, clause e, to the extent necessary to achieve cost parity to the consumer.

3. The CIEP shall have open enrollment periods determined by the AtlasCare Health Directorate.  Those with changes in condition or subject to increased premium cost at their current insurance provider may enroll in the high risk pool program through special enrollment so long as they have maintained coverage through AtlasCare or another insurer prior to such change in condition.

4. A Risk Adjustment Program will be established to involve private providers with annual net income greater than $50 million. Plans with lower actuarial risk will make payments to plans with higher actuarial risk to adjust for variation in distribution of high risk patients. This program will be administered by the Health Resources & Services Administration.

As fond as I am of pomp and circumstance, seeing as this particular bill is an emergency measure to combat domestic terrorism without which my office is unable to effectively address the bombings and mass killings sweeping across Lincoln, I do hope it won't be delayed more than is absolutely necessary.
