Title: Does law enforcement need a warrant to search a vehicle?
Post by: HillGoose on March 13, 2019, 08:40:58 PM
Some guy in high school told me that they did, and that one time he got pulled over and they were going to search his car but he said "I do not consent the search of my vehicle." and they backed off, but like is that true?

If police have probable cause to believe a crime has been committed, they can search your vehicle without a warrant.

Yeah. Same standard as any other search of a home, etc.

A brief stop of the car with no comprehensive search, though, can be done with just the weaker reasonable suspicion standard.

Never tell a cop it's ok to search your vehicle.  It doesn't matter if you have anything or not.  And definitely don't do what my daughter did once.

cop-can I search the vehicle
daughter-yes, but not the glove box

guess where the first place they looked was....

No, contrary to what Jay-Z tells you, THE POLICE DO NOT NEED A WARRANT TO SEARCH YOUR CAR, though they do need probable cause.

Well that blows.

Anyway Jay-Z didn't tell me that but some guy named Nestor in my high school did, back in like 2012.

Yes, they need a warrant subject to exceptions. The only reason they ask to search is because they don't have the authority and need the driver to agree to the search and waive his rights.
