Title: Re: SENATE BILL: Freedom of Color Act (In need of Sponsor) Post by: ON Progressive on March 19, 2019, 05:48:33 PM Under current trademark law, you can claim a colour to yourself within an industry under certain conditions.
The idea is to prevent misleading products, but it doesn't seem particularly logical that colour alone would lead to people confusing two brands. As Ninja said when he introduced this bill in the House, Starbucks could sue another coffee company if their logo has their green on it, even if the logos are drastically different. That doesn't seem reasonable to me, and that is why I urge my colleagues to support this bill.
