Summary:

The goal of this bill is to amend the rules for civil lawsuits to limit abusive practices and lower healthcare costs by reducing malpractice insurance costs.

Section 1 caps punitive damages in tort suits at 4 X the actual damages. The Supreme Court has ruled that anything 10X or higher is unconstitutional.

Sections 2-3 cap “pain and suffering” damages in medical malpractice lawsuits at $500,000.

Section 4 prohibits expert witnesses in civil cases when the expert witness would make money from the trial outcome.

Section 5 caps contingency fees lawyers can charge when representing clients, to prevent disgustingly high legal costs.

Section 6 bans civil suits against food producers and restaurants related to obesity.

Section 7 creates a method for sanctioning lawyers who file several frivolous lawsuits.

Section 8 limits lawsuits against drug manufacturers when they complied with all FDA requirements. A federal version of this rule just passed the Atlasian Senate.

Section 9 codifies charitable immunity for indigent healthcare.

Section 10 sets a statute of limitations on medical malpractice suits.

Section 11 creates an administrative law vaccine court to handle lawsuits against vaccine manufacturers.
