This was the most likely result at this point. The 4th Circuit didn't exactly hold that discrimination against transgender students violates Title IX. Rather, that court held that Title IX regulations were ambiguous enough that the Obama administration's interpretation of the law should be afforded Chevron deference. Trump has of course repealed Obama's guidance on Title IX, so the 4th Circuit's decision is sort of rendered moot. The lower court will presumably now have to answer more directly whether Title IX protects transgender students before this comes up to SCOTUS.

Probably the right decision given the change in guidance and the fact that we only have 8 SCOTUS justices currently.
