Laurence Tribe would be a likely nominee. Main drawback is that he's a bit on the old side, born in 1941. Democrats seem to like screwing themselves by nominating old more experienced people.

Responsible governance is a cross to bear.  But it might come back into vogue, if enough calamities pile up.

First of all, John Kerry would have gone to Louisiana himself and literally pulled people out of the water just like he used to do -- in Vietnam.

He'd appoint Hillary Clinton to be Chief Justice of the Supreme Court and Sandra Lynch (First Circuit) to be Associate Justice.

Tribe has written too much and is too old to be a feasible nomination.

kerry was such a bad candidate. so i am often thankful that he isn't president as he could have destroyed 20 years of hard work from the democrats.

The democrats now have a strong base (200 electoral votes) and what might have been keeps these states frimly in our column. we are so organised in WI,Mn,Or, Mi and PA that it is becoming increasingly difficult for the reps to win.

So try not think about a kerry presidency. bush is the best democratic fundraiser.

What a nightmare!

He'd appoint blatant activists who would vote to allow anything under the commerce clause. Federalism would be dead for another 20+ years.

It's hard to say, but I can safely imagine they would use international law and/or law in whatever country that justified their opinions as basis for decisions about 50% of the time or better, or when there wasn't liberal presidence on which to base a decision in the US. Considering how Euro-centric and rest of the world-centric Kerry was and considering that the above is a disturbing trend in the beginning stages amongst left of center judges, I just conclude that's a quality Kerry would find admirable and SCOTUS worthy. When I think he could have replaced O'Connor and Rehnquist with that, I'm once again reminded why I'm glad he is not in. Smiley
