News Article

Opinion

They've upheld the Assisted Suicide Law 6-3 with Kennedy writing the opinion and O'Connor in the majority along with our four liberal friends. Roberts, Scalia, Thomas dissented.

Why? Because you agree with the ruling or because Roberts voted with Scalia and Thomas?

Good decision. While I'm somewhat undecided on assisted suicide this would set a worrying precedent if the federal government could just butt in and nullify state laws allowing things they don't like.

The Court did the right thing for all the wrong reasons.

If you read the decision, it doesn't say that the Feds can't prohibit assisted suicide, only that the Controlled Substances Act doesn't gove the Attorney General authority to say whether assisted suicide is a "legitimate medical purpose".  I predict that there will be, if not already filed, a bill to amend the CSA to say that assisted suicide is not a legitimate medical purpose.

And what does that have to do with anything?

Just what I said, that there will be a bill introduced in this Congress to do exactly that, and if passed, we'll get to have this relitigated on different grounds.

I'm talking about the 'If you read the decision' line. What did anyone say that conflicted with this?

LotD implied that he thought that the Court had ruled that the Feds couldn't interfere in assisted suicide.  I was pointing out that the decision was decided on narrower grounds.

Aren't Roberts, Scalia, and Thomas supposed to be the ones who favor states' rights?
