The gym I work out in has TVs turned to FOX News on it so I've found myself watching it the recently and it's full of nothing but supreme court bashers.

This woman Laura Ingraham is the biggest idiot of them all as she was spewing this nonsense that the Supreme Court has no right to overturn the "will of the people" that voted for the child rapist death penalty referendum in Louisiana by a 60-40 margin and how they don't understand what the electorate determines as the "consensus right v. wrong answer" because they unfairly don't have to face re-election.  If anything, that's why I like the idea of the Supreme Court.

Anybody remember Adolf Hitler and the Nazi Party of Germany?  Their whole Kill the Jews, Gypsies & Anything-in-Between plan wasn't the result of a military coup or the support of an evil dictator, it happened like this:

The duo of an unelected Supreme Court + Constitution was set up exactly for something like the Nazi situation.  It's freedom and democracy's last stand if something were to go wrong (i.e. every Muslim American was sent to a death camp after 9/11). 

All it takes in this country to stop a corrupt majority from oppressing the minority is one person to file a lawsuit and convince 5 people--5 of the only 9 people in Washington who don't care about polls or lobbyists or fundraisers or that the majority opinion is the majority for that matter--that the oppression is wrong.  The Judiciary Branch is the only branch in the U.S. Government set up to help the little guy; to help Mr. Smith when he goes to Washington.

Laura Ingrham scares me. She just seems completely filled with venom and hate.

I don;t like the idea of legislating from the bench, but I get sick of hearing about 'judicial activism' whenever a decision goes against them. And, sometimes, the constitution is more important than the current will of the people.

Yes, but what if the Supreme Court is on the opposite side of both the people and the Constitution? Even though having the death penalty for child rapists is an nonsensical policy IMHO, they had no constitutional authority to overturn it at the state level.

The Supreme Court deserves to be hated for their Bush v. Gore ruling.

Uhm...the 14th amendment coupled with the 8th. I might be able to entertain an argument it's not cruel and unusual, but the 14th amendment certainly gives them every right to consider punishments of state criminal courts.

     I agree totally. They're only human, but there are many times in the history of our country that they turned us away from the path to a totally despotic state.
