I'll probably be presiding over this one (not 100% certain yet), but we should get through the preliminaries:

1) Will bgwah will be presenting the case for the prosecution?
2) Does East Coast Republican have counsel or wish to have counsel appointed for him?

Alright, I'm contacting East Coast Republican via PM.

If no response is given, the court may appoint counsel for him on its own.

Re-reading the Supreme Court Bar Act...

https://uselectionatlas.org/AFEWIKI/index.php/Supreme_Court_Bar_Act

I see no requirement that defense counsel be a member of the Supreme Court Bar, if such legal counsel is employed by the defendant.

The only requirement appears to be in Section 3, Clause 2, which requires said defense counsel to be a "active Atlasian citizen".

As far as I can determine, Hamilton qualifies as an "active Atlasian citizen".

If the prosecution wishes to challenge Hamilton as defense counsel, they may lodge an objection within the next 48 hours.

My next preliminary question to the defendant, East Coast Republican or his counsel, is:

How does the defendant plead?

According to the Act, the only limitation appears to be that counsel be an "active Atlasian citizen".  I don't see where forum mod review is even relevant on the subject, but I'm open to hearing challenges from the prosecution on this.

Lastly, quiet in the court (to the PPT)!

Well, that would technically limit his "activity", no?

Yes, but presumably "active" in the statute means the same thing as "active" in other Atlasian election statutes, which, as far as my knowledge, does not include any limitations on "activity" that would pertain to mod review.

If part of the statute states differently, or could be interpreted differently, as I said before, I am willing to listen.

Next, we'll go to selection of a jury, but I may not get to that until tomorrow.

East Coast Republican, this is my first and only warning to you:

If you are unable to use language or maintain decorum that befits the manner of normal society, the court will be forced to bind and gag you.

ok, the basis of our jury selection is still found in the Jury Reform Act here:

https://uselectionatlas.org/AFEWIKI/index.php/Jury_Reform_Act

I will post a list of Mideast citizens (ECR is from Ohio according to my records) and consult the I Ching as to our jury members.

Wait a minute, he vote in the Southeast Senate Election if I recall.

Yep.  Made a mistake.  He is a member of the Southeast and I've requested the correct list as such.

List of Southeast voters:

*AHDuke99 - SC
*Andy Jackson - TX
*Bacon King - LA
bigzcorey - TX
*brandonh - LA
burkenelson - PR
*Chuck Hagel 08 - GA
Clay - GA
*Cosmo Kramer - AR
*Daniel Adams - FL, governor
defe07 - FL
*deldem - TX
East Coast Republican - FL
jbase - TX
Luis Gonzalez - FL
*gporter - TN
*John Dibble - GA
*justrhyno - FL
*Lucysbeau - GA
*North Carolina Yankee - NC
*PiT (The Physicist) - LA
SamInTheSouth - SC
*titaniumtux - TX
Willy Woz - TN
*Xahar - AR

I have starred those voters who voted in one of the last two Atlasian general elections, as the potential jurors I will choose from will be limited to these so that we have jurors who will be active.  I have also crossed out East Coast Republican for obvious reasons.

This leaves me with 16 potential jurors.  I shall announce the six selections in a few minutes and send out PMs.

I have consulted the I Ching and have chosen the following citizens as jury members:

Andy Jackson
Chuck Hagel 08 (South Park Conservative)
Cosmo Kramer (jokerman or as I remember - Preston Caldwell)
Daniel Adams
DelDem
John Dibble

I will send out PMs in a little while.

I'm noticing that the Jury Reform Act limits juries to five jurors.  I will remove one of my selections in a second and make him an alternate.

As to the two folks who haven't responded, I'm sending reminder PMs out right now.  If no response is given in 24 hours, consequences will result - probably the same that I've used before.

Unfortunately, I don't think I will be able to be a juror. My life outside this forum is far too busy for many reasons, and I won't have time for this.
Currently on my plate:
1. School workload is very heavy for the next few weeks
2. College Apps
3. Extracurricular stuff I've already committed to.
I apologize for the inconvenience I know this causes, but I honestly don't see how I could do a good job if I can't be on for more than 5 minutes at a time after today.

Ok, that's fine and you're excused.

I'll be selecting another juror in the next few minutes and sending out the PM.

To replace Deldem as juror, I have consulted the I Ching and have chosen Brandon H as juror.

He will be e-mailed a PM in the next couple of minutes.

It is now been 24 hours since I sent a checkup PM to Andy Jackson.

Due to the necessity of continuing this trial in a speedy manner, I must therefore find Andy Jackson in contempt of court and order that his voting privileges be suspended until he posts in this thread or this trial is over.

I am well aware of the Contempt of Court Act passed by the Thirtieth Senate and its insistence that such actions be prosecuted as crimes.  He last visited this forum on October 30, 2009 at 8:26:39 AM, so the Act is relevant

It is my opinion that if Andy Jackson does not contact me in this thread before the end of the trial, the dogs of war shall be let open by the Justice Department.  If he does and provides good reason for such absence prior to the end of the trial, I shall determine whether he is prosecutable for contempt of court under the Act.

As this trial must proceed, I have consulted the I Ching and selected another juror from the pool.  The lucky citizen who gets to participate in this jury's august deliberations is:

PiT (the Physicist)

He shall have 48 hours to swear in - or I have to consult that I Ching or a Chinese prostitute again...

I have been contacted by Andy Jackson and have a legitimate excuse for his not answering the jury summons.

Therefore, I waive the contempt of court citation against him and release him from jury service.

Counsel for the state, you now have 72 hours to present your case against the Defendant.
