Gillibrand: 45%
Pataki: 44%

This SRI survey was conducted November 8-12, 2009 by telephone calls to 800 New York State registered voters. It has a margin of error of + 3.5 percentage points. Data was statistically adjusted by age and party to ensure representativeness. Sampling was conducted via random digit dialing weighted to reflect known population patterns.

I think that there's greater than a 50% chance that Pataki will run, but I doubt Giuliani will.  It's just not in his cards to go to Washington.  Giuliani may very well run for the gubernatorial race, though.

The Democrats shouldn't fret, though.  Even against a weak incumbent like Gillibrand, it's unlikely that someone like Pataki is able to win.
