Ninth Circuit Court of Appeals erred by substituting its own judgment for the jury's in the 'shaken baby' conviction of a California grandmother, the Supreme Court said. The reversal will send Shirley Ree Smith back to prison.

The 9th lost on a technicality. Their actual decision wasn't all that nutty.

Referring to the Court of Appeals for the Ninth Circuit as the 'nutty ninth' (in all lower-case) no matter what it does is an article of faith for the Right, you see.
