I don't know. If not, that IS really stupid. What if Bush won the state, and then lost 31 electoral votes. Would Kerry win?

It's a fixable mistake.  At worst, if Kerry had won and this was used as a technicality to force the vote into the House because no won had 270 votes, then the GOP would be toast politically if they used it to get Bush in via the backdoor, so Kerry would still have gone into the White House.
