In my recent reading of the constitution (I have read numerous times now in an attempt to better prepare myself for the job I now hold) I realized that there is a gigantic loophole in the constitution regarding voting requirements.  The following passage is found in the Voting Requirements article of the Constitution:

"No one who has attained eighteen posts, is an active member of the forum, and has established an avatar from the United States for at least the time span of the election shall be denied the right to vote. An active member is defined as a person who has participated in other threads at the forum and has not joined for the purpose of trolling."

Eighteen posts allows a member of the forum to register as a voter in the Fantasy Elections board.  However, a registered member is also required to maintain a certain level of activity (though that level is undefined in the constitution) and refrain from trolling (also undefined in the constitution) in order for he or she to be considered valid voters.

Therefore, effective immediately, the Office of the Secretary of Forum Affairs will only recognize the votes of those who have posted a minimum of 25 posts in any board on the Atlas Forum in the period between elections.  This will not affect first-time voters.
The amount of activity needed is defined clearly in the constitution on my reading. "He has participated on other threads at the forum". So, one post outside the Fantasy Elections section would appear to be sufficient, whether you like that or not.

NEWS UPDATES 1/4/05

1.  Updated Registration Lists!!  These include the few new members who have joined, a couple of party changes, and the newly created John Engle Party.

You will also notice that I have deleted the tallies of party registration data in the Regions and Districts registration data posts.  These were simply too much of a hassle to maintain, particularly when anyone can take a few minutes and count that information up themselves.  The registration by party thread will continue to have an updated breakdown by party.

2.  The constitution states that, "No one who has attained eighteen posts, is an active member of the forum, and has established an avatar from the United States for at least the time span of the election shall be denied the right to vote. An active member is defined as a person who has participated in other threads at the forum and has not joined for the purpose of trolling."

I have come to the conclusion that NixonNow has indeed joined for the purpose of trolling.  This is evident in his impersonation and harassment of Htmldon, his multiple registrations under various names, and his generally lewd and mischievious conduct on the forum.  I have therefore deleted NixonNow's registration and hereby declare his registrations under all of his various screennames invalid.

If he wishes to appeal this decision, he may sue me and let the Supreme Court decide the issue.

Yeah, I think that decision is warranted by the Constitution.
Although it might be said that not all his posts are trollish (look at his NJ Election Atlas for example), he seems to have indeed rejoined the Elections Forum for the purpose of trolling.

Mike you should file a suit with the Supreme Court. You broke no laws. Trolling is not a crime, its just annoying. The SoFA had no legal right to delete your registration.

I'll post what I posted in the Constitutional Convention given that this matter came up:

 The SoFA has actually broken the law as a matter of course.

The Constitution both in the present version and our proposed version contains the following language:

"No agency of government shall deprive any person of life, liberty, or property, without due process of law"

Clearly the right to vote is a liberty in the sense meant under this clause. Given that an accusation of trolling has been made there still needs to "due process" because there is no quantifiable way for one to determine whether he is a troll in the same sense that it can be quantifiably determined if somebody has voted in the last two elections. Due process in this case, I believe, would be by a jury trial.

If an Executive agent can determine one person is a troll without a check or balance on him, then he could determine any of us to be trolls, and that is the first step to tyranny.

If Mr. NixonNow wants to sue the pants off Steven, he will probably win, whats more, I'd represent him if he were willing. Undoubtedly, NixonNow's behaviour is trollish, that doesn't mean the executive gets to act as judge, jury and executioner, especially given that trolling can never be strictly quantified.

The fact is trolling is a broad term and is not defined. To me, trolling is not against the law, and Mike should sue and have Peter Bell as his council. If Mike decides to sue, I would like to second chair along side Peter.
