Section 86a, subsection (3) of the German criminal code states:
"Subsection (1) shall not be applicable if the means of propaganda or the act serves to further civil enlightenment, to avert unconstitutional aims, to promote art or science, research or teaching, reporting about current historical events or similar purposes."
That's also the reason why
Inglourious Basterds isn't banned in Germany. It's "art".
Well that and the fact they probably wouldn't dare to interpret the law in a way that would hurt the commercial interests of Universal Pictures or any other major Hollywood studio.
