I feel the need to apologize again for my mistake. It really was an unacceptable one, and I felt tremendously guilty for having made such a stupid blunder. Atlasia has every right to be furious with me. All that I can say in my defense is that I have made mistakes in almost every election, and I made another one here, in spite of my best intentions and efforts. This is a difficult and a time-consuming job, and sometimes in my efforts to perfect the details of an election I make a thoughtless error.

I will resign if the people have lost confidence in my ability to administer an election, or if the President wishes to fire me for my mistake. Otherwise, I am prepared to defend my Department in court (again) if need be and work all the harder to serve the people better in the upcoming presidential election.

I don't think resignation would actually solve the problem. If I may make a suggestion, homely, perhaps you should author legislation to be introduced in the Senate that allows the SoFE the leeway to close the voting booth and reopen a new, corrected one so that all voters have a chance to recast their ballots? Perhaps allow you a maximum of twelve hours after the start of the election to make any change?

There is already legislation pending in the Senate queue that would do just that, actually.

Well, you know what they say about great minds... Wink

You're welcome. Wink

Atlasia has never had a SoFE as able as Homelycooking as far as I'm concerned.

Sure he made a mistake.

I've made mistakes.

Are there any of you who have not made mistakes?  I think not.

Get over it.

Keep up the great job Homely.  You have my full support, and I believe the support of the vast majority of Atlasians.

Notice to the SoFE

Executive Order

In all future federal elections, the election administrator shall be required to post a sample ballot at least 24 hours in advance, to ensure the validity of the ballot and raise awareness for the upcoming election.

Fair enough. The one time that I neglected to post a sample ballot, I paid the price. A little bit of legal "reinforcement" is just the thing needed here.

Only the senate can do that. Article 1 Section 4 Clause 6 of the Atlasian Constuition is the final authority on this matter. Thus your excutive order does not meet the demand. You have till 2pm Wednesday EDT to fire or homely resigns. Failure means I go to the Senate to seek an impeachment of both you Napoleon and the VP.

Article II, Section 1, Clause 1 is the final authority on the matter. I'll even quote it for you.

See that?

The Senate makes the laws, and I decide how to execute them, as I just have. Case closed. Sue me if you wish. I will not be firing the SoFE so you can go ahead and start it right now.

I'm giving you a chance to make this right. Only the senate can do what you purport to do. I'm not gonna stand for your attempt to ursurp power specifically ment for the senate.

As a member of the Atlasian Supreme Court Bar and a former Attorney General, I would like to state my equivocal legal opinion that the President has the power to order the head of a executive department to comply with the law.  President Napoleon in no way violated any law passed by the Senate nor did he overreach his executive hand.  His order simply instructs the SoFE to prepare a proof of the forthcoming ballot for public scrutiny and review before an election takes place.  The aforementioned section of the constitution is applicable to administering the actual election - not a draft ballot that I would assume would be posted in this office and would be totally invalid to cast a vote on.

Barnes, what happens if an individual declines to follow an executive order (purposefully or not)?

The executive order issued here was specifically for the SoFE, and seeing as that is a federal executive department, the President would determine the consequences (if any).

It appears that Homely normally does post the draft ballot before the polls open, just out of principle. Obviously, his failure to do so this time was not out of an intentional desire to create problems. Thus, as I see it, had this executive order been issued three months ago, Homely could still very well have made the same mistake and we'd be exactly where we are today: without a way of actually rectifying the error.

That is why I will continue to push for the passage of the Election Do-Over Act. By all means, this bill is a work in progress—it may drastically change. I hope we'll be able to reach a consensus in the senate.

Had this executive order been issued three months ago, I would have been asking Homely where the f-kk the ballot is   before the election ever started.

Not every president will be the Great Napoleon.

If the SoFE is absentee, the responsibility to administer the election falls to the Deputy SoFE, or the President. This is a requirement for the election administrator, so if the SoFE isn't available to post a sample ballot, someone else will have to.

It's a matter of how much faith you place in the words "have to." While you may do a great job of enforcing your executive order, future presidents may not. In that case, whether the SoFE, Deputy SoFE, or whoever "has to" do something means very little.

Because most of those requirements are codified in Atlasian law, not executive orders. And the failure to meet these legal requirements would  carry more repurcussions than the failure to meet your executive orders. That's why I want a law.
