They'll sever, striking down the "mandate" and guaranteed issue provisions and leave the rest of the bill pretty much intact.  It only helps Romney, because he can argue both that the central pillar of the bill was unconstitutional and that it's otherwise too expensive and badly crafted.  When Romney is questioned about why he supported mandates, he can just say there's nothing wrong with mandates imposed by the states.  It only hurts Obama, because of the first reason cited above and because the left isn't going to get worked up into a lather of enthusiasm about defending a mandate to purchase insurance, since lots of them are for single-payer funded through taxes anyway.  Obama is then just a president whose signature piece of legislation was based on a provision that violated the constitution--makes a great bumper sticker....for Romney.

I may well not have health insurance next week.  as a consolation prize I get to listen to Limbaugh and Levin tell me I didn't want it anyway because I don't want to be dependent on my parents, and that everyone has health care in the US because we're free to get care in an ER.

I hope that Obama was so confident about it those weeks ago because someone gave him the inside tip.  If not, he comes across like a huge ass.

Because Obama's too politically savvy for that, I think the Court upholds.

I don't think the Supremes have enough faith in Congress for the "Strike down just the mandate" option.  Tongue

I don't have much faith in the reactionaries on the Supreme Court at the best of times, but I'm at least hopeful they'll uphold. It's worth remembering that the healthcare lawsuits were originally considered a fringe activity with no chance of ever reaching the Supreme Court, and only gained credibility (such as it is) through the backing of a certain major political party...

Then I really hope they uphold the whole thing. Striking down the whole thing would be the most egregious abuse of judicial power.
