Roberts is the only justice who voted that it wasn't OK as part of the Commerce Clause, but was OK as a tax.

It's better than the current system especially since if read as "a tax" it's a backdoor to single-payer.

Kennedy is reading the dissent and is arguing that the whole of the ACA is unconstitutional.

Roberts opinion holds that individual states may refuse Medicaid expansion funds.

"Nothing in our opinion precludes Congress from offering funds under the ACA to expand the availability of health care, and requiring that states accepting such funds comply with the conditions on their use. What Congress is not free to do is to penalize States that choose not to participate in that new program by taking away their existing Medicaid funding."

No, he's just not willing to exert the Supreme Court's power so far as to throw out a major legislative initiative where the precedent was clear. Most of the time he's a solid conservative.

OK, that takes care of the Presidential race this year.  I'll bet the Repubs are now really pissed that they "settled", to use Michele Bachmann's term, for a moderate like Romney.  I predicted that any GOP candidate would win this year and this ruling just seals it. 

Unless Gary Johnson gets enough libertarian-oriented votes to swing states like Nevada, Colorado, etc. to Obama.

The Medicaid expansion would have offered health insurance coverage to 16 million people. Now states apparently can make up their own minds whether or not to accept the expansion – and that means if Florida, Texas and other big states knock it back, then there will be millions of Americans who will miss out on the healthcare reforms.

I have to say that forcing a small government state like Texas where 25% of the population is uninsured to vastly expand Medicaid was going to run into political problems anyway...

Now that the mandate issue has been settled, it gives the Democrats the opportunity to return the focus to the rest of the law -- the stuff people like, like not being denied health insurance because of a pre-existing condition.

The court is still pretty right-wing. 4 of the justices, including Kennedy voted to kill the whole thing. 5 of the justices voted that the Commerce Clause doesn't allow for such things. ACA really dodged a bullet here.
