A major part of the controversy over the re-authorization of Violence Against Women Act was that the law in its new form would allow for trial of non-tribal members in tribal courts, and thus constitutionally problematic. I've read the concern is over due process protections.  Is this unprecedented, or have individuals been tried by courts of tribes they don't belong to?  It seems that, like last time VAWA was past, a Supreme Court case could be likely.
