This ruling is a major victory against insane government micromanaging and bankrupting of farmers.

He shouldn't.  It's an absolute banana republic power grab that has no place in our country.  How would you like it if implied consent to have up to half of your assets seized and auctioned below market value was required to start one of the oldest and most basic businesses humans have ever run?  Would it really make everything right if a small percentage of the seized assets might sometimes be used to help the poor?  And no, this is not the same as paying taxes on your income.  A wealth tax is explicitly unconstitutional and property taxes are never anywhere near half the value of the property.

And I like FDR as much as the next person, but for goodness sake, feeding your own family with your own crops is not interstate commerce!  That's a precedent I'm happy to move farther away from.

My hyperbole complaint more had to do with you accusing the government of actively trying to bankrupt grape farmers. I of course agree that the law needs to go and was outdated.

Sotomayor's dissent is pretty compelling, and the hyperbolic imagery heard during the oral arguments could have made anyone's stomach churn.

Most unsettlingly , this puts a whole host of New Deal-era programs at risk and the Court should have further considered the economic implications of the dismantling of this and similar programs.
