Department of Justice

This will serve as the official Department of Justice thread, covering the actions and initiatives of the Justice Department and providing a place for citizens to raise concerns or ask questions.

As Minister for Justice in this first government, with responsibility for legal and constitutional matters, immigration and citizenship, my first order of business will be to draft a Government of South America Act, compiling, clarifying and, where necessary, expanding upon the work done by the provisional parliament to set up the fundamental structures of this new nation.

I thank the Prime Minister for entrusting me with this prestigious and important portfolio, and I look forward to working with my Cabinet colleagues and all other members to craft a sustainable, fair and clear framework for government. We are ready for the road ahead.

X Oakvale, MP
Minister for Justice

The government will be introducing a comprehensive bill to address many of the concerns raised during the last election in the coming days.

A question, which I hope is not too far afield. What is the status of recreational drugs, or intoxicants not sanctioned for medical purposes, in our state? Is our government torching coca fields in Colombia and the Andes region and combatting drug barons and smugglers active in the region? Or are drugs legal and regulated (if so, which drugs)?

Thank you, Minister.

Hi Yelnoc,

Presently, as with all other policy upon the foundation of the state, drug policy is at the status quo - that is to say each constituent nation maintains its own independent policy. Obviously this is not ideal and this an issue I plan to address following the introduction of legislation for a constitutional settlement and my subsequent legislation on labour law.

Department of Justice - Constitution Act introduced

I have today for the government introduced an act establishing a Constitution of South America. As I said in the house, I welcome any and all suggestions and contributions from all members, and indeed from the public.

With the rules of order established and, hopefully, this Constitution passed, this government will then be free, with the structures formally established, to allow the Prime Minister to seek the confidence of Parliament.

X Oakvale, MP
Minister for Justice

Mr. Speaker,

In my role as Minister for Justice, I have today introduced the Constitution of South America Act on behalf of the government, outlining and codifying the structures of this nation. It builds upon and clarifies the work done by the Provisional Parliament, and, after consultation with the rest of the Cabinet, I welcome any input from those members on the opposition benches and indeed those in government who are outside of Cabinet.

We have authored this act not as a fait accompli, but as a necessary and limited foundation upon which to build - it is not a list of The Rights Of Man or specific policies, but a necessary and functional document aimed at outlining the fundamental structures in which we operate and to address the concerns raised during the election period.

Upon passage of the Constitution, and with the first 'establishing act', namely the election of your good self and the passage of the rules of order, the Prime Minister will address the house and formally seek the confidence of Parliament in the government's policy agenda.

To paraphrase an old poem, two roads diverged in a yellow wood - one led to a healthy and vibrant democracy, full of life and with thriving debate. Another led to Atlasia. Mr. Speaker, let us take the road less travelled.

Department of Justice - Statement

Good evening.

There has been some confusion and some conflicting stories about the events in Colombia yesterday evening, so on behalf of the government and in my role as Minister for Justice, I wish to set the record straight. As this was an effort that involved multiple state governments, no one country yet has the full story.

At 8PM yesterday evening, acting on the orders of the Cabinet, an elite commando unit raided a compound in Guaviare, Colombia, where a journalist by the name of Daniel Rojas was being held. The kidnappers had demanded the release of known terrorists in exchange for the safe return of Mr. Rojas.

Using a highly potent gas, fentanyl, the troops managed to subdue the forces at the compound, believed to be affiliated with FARC, and successfully rescued Mr. Rojas and 29 Colombian soldiers who had been held hostage for some months.

On route to exfiltration, our special forces were ambushed by FARC soldiers. After a firefight, they successfully saw off the attack, killing two FARC officers. Five of our soldiers lost their lives to save those of Mr. Rojas and the imprisoned soldiers.

The Prime Minister is meeting with the leaders of our constituent nations and their militaries in preparation for further action, and will issue a more detailed statement shortly. The deputy prime minister is meeting with the families of the hostages and those bereaved to offer his support and condolences on behalf of the government.

The government wishes especially to express it thanks to the leaders of Brazil and Colombia for their coooperation in this effort. It would not have been possible without the skill and dedication of their forces. The success of this operation is evidence of the fact that South America is at its strongest when it works together. And, above all else, let the message be clear - this government will never negotiate with terrorists.

Thank you. I imagine there will be further details later.

Department of Justice - Statement

The Constitution Act has passed overwhelmingly. In the house, I made some brief remarks expressing my thanks to all who voted for the bill, including members of the opposition who put aside their differences to come together to build this nation.

Mr. Speaker,

Today marks an important step on the road to building this new republic. I would especially like to thank all those members of the opposition who put aside their political differences with this government in the interests of the nation and voted for this Constitution. We now have a Constitution, and we have achieved this quickly and without the tedious legalism that has collapsed nations in the past.

Problems lie ahead, of course. In our own land, rebels and drug cartels continue to wreak havoc. Myriad economic challenges face our constituent nations. To our north, the pigheaded isolationists squawk and squeal at the thought of granting our nation diplomatic recognition. But this government stands ready to meet these challenges. With that in mind, the Prime Minister will now move to holding a vote on a motion of confidence on a sweeping policy agenda that will continue our work in moving South America forward.

The Justice Department, cooperating with the Department of Foreign Affairs, is aware that the Communist candidate for the Presidency in Atlasia has called for the imperialist annexation of all of Central America, and is monitoring the situation closely.

It is to my astonishment what kinds of business the Minister for the Judiciary could possibly, in name of his ministry, have with the aformentioned situation, but I am sure he will be ready to answer this question to an interested and even startled citizen. It seems to me that the present government is far more invested in the dealings of a foreign nation than in properly conducting the job it was elected to.

As the responsible Minister for citizenship and nationality, I pay close attention to matters within our sphere of influence in case of the event that we need to provide shelter to refugees from a Northern invasion, as I believe would be our moral duty. The Minister for Foreign Affairs has already declared South America a refuge for the dispossessed from Syria - I fear we may have to do the same for our neighbours all too soon.

I assume the Socialist Party, not being Communists, will join with us in expressing concern over this outrageous proposal, and I thank you for it. On this all South Americans can agree.

I thank you for your quick answer. I still think that this is a matter for the Foreign Minister, but alas, it would be a wonder if the excuse of a government we suffer from had got the distribution of responsibilites and portfolios right.

The Socialist Party however obviously is concerned about any sort of Atlasian imperialism - our continent has long enough suffered from it, after all!

The Foreign Ministry is actively tracking the situation. We had not wanted to unduly inflame any tensions with Atlasia given the potential for establishing diplomatic relations, but alas, isolationists prominent in their political process have made that a slim possibility regardless.

I am drafting an alternative to the amendment currently being voted upon to resolve the issues surrounding the replacement of inactive members through statute rather than constitutional amendment.

I am not entirely sure why the government is choosing to sponsor separate legislation instead of proposing an amendment to the proposal already on the floor to change it to statute.

I'd just like to be clear that the Department is closely monitoring the activities of Mr. Afleitch and reserving all options to deal with any hint of a threat to our national security.

Department of Justice - Action on the Emerging Situation

Good afternoon.

Early this morning, local police , assisted by federal peacekeeping forces, dispersed the crowds of protesters attempting to barricade Cochabamba and cut off our provisional capital from vital supplies. Overwhelmingly, the local police and our forces carried out their duties diligently and with responsibility and care. I will note that some of the tactics utilised by the local police were not sanctioned by the South American government, and I am ordering an immediate investigation into the use of heavy-handed riot control tactics by some among the Bolivian security services, which risked inflaming the situation and lead to isolated incidents of conflict between the two cooperating forces. I wish to stress that these incidents in no way reflect on the conduct of the vast majority of the security forces, but I believe it is important to ensure all South Americans, and in particular the protesters, that any action taken above the minimum required to preserve our security and that of the city will be dealt with.

The immediate threat has been removed, and it is my hope that the leaders of the protests will now meet with the Government to discuss their legitimate and real concerns without attempting to hold Cochabamba hostage, endangering livelihoods and lives. I would also like to thank the military and the churches for their utterly crucial role in transporting vital supplies and equipment into the city at significant risk, and preventing the risk of a siege situation developing.

It now appears that the National Congress of Labor, affiliated with the Socialist Party, is to launch a general strike. I will be clear - the Government condemns unequivocally this reckless and politically-motivated action. It is an absurd situation that the official opposition can attempt to hold the nation to ransom for political gain, and we will not stand for it. The protesters had clear concerns and valid grievances that can be addressed not through mass chaos and anarchy, but through political engagement.

It is no exaggeration to say that the National Congress of Labor increasingly represents a threat to our national security.

To that end, should this strike, which can do nothing but harm the interests of the people the NCL purports to represent, continue I will be introducing emergency legislation to curb the power of this self-interested behemoth, which neither represents the vast majority of South Americans nor has their best interests at its heart. Among the provisions of this proposal will be -

  • The "closed shop" will be made illegal across South America.
  • A ballot of the general membership of a union will be required for any strike action.
  • Public service unions, specifically in law enforcement and health, will be barred from taking strike action under severe penalty.
  • A process will be established for pan-South American legal recognition of labor unions, establishing the rights and responsibilities of striking workers.
  • The National Congress of Labor will be split into separate unions, each which must hold separate ballots to take strike action - a union for industrial workers, a union for public administration workers, etc.

My message to the N.C.L. is clear - let us work together to find an acceptable compromise before it is too late. The people of South America do not want this strike, and my bet is they will not appreciate their livelihoods being toyed with for temporary political gains. This Government believes that labor unions play an important part in our democracy. It is thus important that they do not attempt to undermine it.

In addition, with the interests of our national security my top priority, I have taken an extraordinary measure in these extraordinary times, and ordered the immediate arrest and detention of Afleitch, the self-proclaimed head of a dangerous armed militia, until such time as the present situation has resolved. As the Minister responsible for domestic security, I have ordered our peacekeeping forces to disband and disarm his ragtag group of militants in order to prevent him using this time of national potential instability for nefarious and anti-democratic purposes.

I have noted the NCL's commendable decision to delay strike action pending further discussions with the Government after the Justice Department's moves described above. I am optimistic that we can find a mutually acceptable solution in the days ahead.

The press office of the NCL issues the following statement:

On returning from a meeting with the leaders of the National Congress of Labor to discuss their concerns, I began to feel lightheaded and woozy. I realised that I had unthinkingly accepted a cup of coffee at the meeting without my official food tester being present. I will be more careful in future.

(I'm sick irl so activity will be sporadic for a couple of days)
