I just checked and there's nothing in the Federal Electoral Act suggesting their votes would be invalid in the runoff. It's entirely possible that a restriction might exist somewhere in statute but no such restriction is specified in the law that covers both voter eligibility and runoff election protocol

I put them back in the voter rolls on the off-chance they do vote in the runoff. Those that don't vote will be re-deregistered.

I just saw this - these voters should not have been placed back on the voter rolls. The election law clearly states that a voter is removed from the rolls the instant they fail to vote in a third consecutive federal election (and in the same section, specifies that runoffs and special elections are considered distinctly from regular elections for the purpose of activity requirements).

I will regretfully be forced to sue if these voters are not removed from the rolls and their votes not rendered invalid

Well there might be a problem with the fact that you're also heavily invested in the outcome of the election, Mr. VP-if-the-supreme-court-sides-with-you, and I find it Deeply Disturbing™ that someone with such a huge stake in this election is the one using his discretion to invalidate votes that not only would be counted under previous SoFE's (such as EarlAW) but could ultimately tip the outcome of the election.
