68% of the courts justices have been appointed by a democratic president.

It also has a reputation of a majority of its decisions being overturned by the SCOTUS

Edit: Of course I confused the 9th with the 10th (I thought someone said Gorsuch might have to hear the arguments, for some reason).

Even the Bush appointee was very skeptical about it. It's going to be kept in the dark basement where it deserves to be. I suspect the SC won't be 4-4 along partisan lines either.
