And who will regulate this? I'm all for the sentiments behind this bill, but it is impossible to stop the NSA from spying on citizens if no one is overseeing those operations.

Yeah, this bill seems to offer no solutions at all, and just issue a broad declaration. That would be fine if it were a suggestion, or campaign promise, but I'd like to know how this would hypothetically be enforced/controlled. (I probably wouldn't support this bill either way, but this doesn't help)

     I am not even sure how this could be enforced. Part of what makes the surveillance state so insidious is the talent the NSA has for operating sub rosa. They could probably pretend to comply while just changing their mode of operation, and we would never know barring another Snowden.

Is the NSA not already bound to the rules established by the federal government?  If the NSA is instructed not to spy or wiretap citizens without a warrant, in compliance with Article 1, Section 8 of our Constitution, then I don't see how an NSA agent could spy or authorize spying on individuals lawfully.

This bill looks fine to me in current form, but I'd support an amendment if enforcement is a concern for what ever reason.

It's unclear to me how much of an issue this is in the wake of the USA Freedom Act of 2015, which reined in most of the NSA's worst excesses. It'd be worth pursuing something like that in-universe, as well as reforms to Section 702 of the FISA Amendments Act, but just a generic prohibition on "spying" doesn't seem to be particularly effective.

SJoyce raises a good point, although IIRC there were a few privacy advocates in the Congress who ended up voting against the USA Freedom Act (i.e. Paul and Sanders) because it didn't go far enough.  I'll research a bit more tomorrow and find out if or how the original proposal was watered down.  This bill might be a good opportunity to try to expand privacy protections if it gets a nice amendment added or two.

So far I haven't found any clear reason why proponents of the USA Freedom Act ended up voting against passage.  At any rate, if this problem was already resolved by past legislation, then passing this bill would be a little redundant.  I will not assume sponsorship.

My sincerest apologies guys, I completely dropped the ing ball on these Senate bill slots. Since it is technically now the start of a new Congress, I'll wait until they are set up before opening up the vote, because I don't want to start the vote in a weird between congresses state.

     Bills that pass from one chamber to the other have traditionally lacked for sponsors. I see above that you requested to assume sponsorship. I have been advised that I can take over these threads in VP Goldwater's absence, so I will do so.

     Senators have 24 hours to object to Senator Scott's assumption of sponsorship.

     Looking over this, it doesn't look like we ever worked out whether this bill was even needed or if previous bills already managed to cover these bases. With that said, I will vote AYE because we badly need to work through the backlog of House-passed bills and passing this is at worst a neutral occurrence.
