So federal law makes it easy to file mining claims on Federal land and at the low low cost of $5.00 per acre. Around 1994 Congress passed a budget rider that prohibits processing new claims due to the low cost and lack of royalties. Section II allows new claims to be processed, increases the cost to market value minus mineral rights, and imposes royalties and a filing fee on claims plus subjects these claims to the Clean Water Act.

Section III streamlines mining bureaucracies, concentrating licensing in the OSM and environmental enforcement in the EPA to prevent regulatory capture while also eliminating a few minor, non-core programs at OSM.

Section IV increases taxes on coal mining which fund the black lung trust fund for coal miner health, streamlines permit procedures, and most importantly eliminates the dumb regulation making it a federal crime for a miner to eat while on the toilet.

Fremont recently passed a resolution requesting federal protection of the Emigrant Crevice area located in Park County, Montana.  Businesses there are demanding maximum protections allowed by federal law to divert the development of industrial mines on the doorstep to Yellowstone National Park, with current protections set to expire soon.

I see this bill as a great opportunity to permanently protect the 30,000 acres split between the Emigrant and Crevice Mountain from foreign mining by putting them off limits to leasing.  While mining in this area is technically illegal under Fremont law, only Congress can protect this public area as it is controlled under the Mining Law of 1872.

I hope that it may be in the interest of the Senate to protect Yellowstone in its entirety, and I am willing to author an amendment to that effect if a member of this chamber would sponsor on my behalf.
