The reasoning for this bill comes from a series of 2009 Supreme Court oral arguments. When the Deputy Solicitor General was asked by the Chief Justice if the FEC could ban a 500 page book on the national political system if the last sentence of the book endorsed a candidate, and the government lawyer said yes! He also said they could probably ban books sponsored by labor unions if they later sold the manuscript to Random House. During the 2nd round of oral arguments on that case, then-Solicitor General Elena Kagan tried to walk that back a little but would still not concede that the FEC lacked all power to ban books. This concerns me and so this bill will clarify that this isnt Nazi Germany.

It also clarifies that if a candidate gives a speech promising to nominate a specific person to a specific office that cant be viewed as "bribery" unless the promise was made in exchange for money. During 2016 some dumb fake noos reporters tried to say Trump having a list of potential supreme court nominees was "illegal bribery".
