the principle of judicial passivism (frankfurter, harlan, burger etc) if the 14th amendment was fixed?

Maybe its disingenuous to say that (like saying that you support all the commandments except for "thou shalt not kill"). But if the 14th amendment allowed for some sort of senate reform, making it easier to pass amendments, ending the EC, making it harder to gerrymander - then the courts wouldn't be needed.
