The Council may override the reference of the governor by a majority three-fifths vote of all elected MCs. If the governor fails to take any action on a bill within 120 hours of its passage, it shall become law.

Section II: Implementation

1. This Amendment shall go into immediate effect once approved by the people of Lincoln.

The Debating Period has commenced. It shall last no less than 72 hours.

This is a sensible amendment to the Lincoln Constitution that will limit the Council's ability to override the Governor. Shifting the override vote requirement from a majority to three-fifths ensures that the powers of the legislature will not be absolute.

As this is a Constitutional Amendment we will need two-thirds approval to pass.

I intend to vote against this legislation. I support the Council being stronger than the Governor and being able to override the Governor with a simple majority.

Regarding The Right Honorable DKrol's objections, I find them totally understandable but, at the end, misguided.

The fact of the matter is that even under this (incredibly well-named) Amendment, the Council's prerogatives would still be of considerable importance against those of the Governor.  The Governor's veto is intended to be advisory and to refer the issue to the people of Lincoln for their ratification, rendering concerns of executive overreach realistically moot.

I could expand more on the subject, but I find this to be a perfectly reasonable proposal that will strengthen our regional government. I exhort Councillors present to vote Aye and am available for any questions or concerns they might have.

The Ayes have it! The legislation is PASSED.

As per Article VI of the Lincoln Constitution, LC 3.12, having been approved by two-thirds of all sitting Councilors, shall be delivered as a public referendum for ratification.

I remember being concerned about the wording back in January and toying with some ideas regarding it last month. Yeah, it excludes the vacant seats.
