Any and all drafted legislation intended for consideration in the 3rd Session of the Council of Lincoln must be posted here. You do not need to be a Councilor to post your bill; however, it is required by law that all legislation be sponsored by a sitting Councilor before it can be discussed and, presumably, voted upon.

It is recommended you check the Lincoln Statute to ensure the item has not been previously addressed.

Finally, this is strictly an introduction thread. No debating or voting is to occur here under any circumstances. For commentary or discussion on bills prior to their formal introduction on the floor, please retain all such posts here. Each bill requires its own thread which shall be posted by the Speaker in conjunction with and adherence to the Lincoln Constitution and the Council Standing Orders.

Section I: Surveying of Coats
1. Using census data, a cross section of 5 percent of all primary and secondary schools in Lincoln that is representative of the region will be randomly selected.
2. For each selected school, Lincoln officials will be placed on location for two weeks in the autumn to survey assess the distribution of costs and number of clothing items worn to school by students.
3. Lincoln will determine median annual outfit expenses based on the data gathered.
   a. Each student is priced to have ten outfits, excluding outerwear and shoes, including undergarments (these costs will not observed obviously, but will be assessed from industry figures).
   b. Of these ten, two will be geared for winter and two for summer. This includes two sweaters and one winter coat per student (outerwear is expected to last for two years, so the successive year's assessment will exclude this cost).
   c. Three pairs of shoes (including one set of gym sneakers) will be included in the cost.
   d. Two gym outfits will be including in the cost.
   e. The top 10% and bottom 30% of outfits in terms of the cost will not be part of assessment.
4. The following formula will be utilized for determining clothing subsidies:
   a. For each family, the number of primary and secondary students will be totaled (in both public and private schools).
   b. 100% of clothing costs will be subsidized for those under 150% of the poverty line + the assessed annual cost for all students in the household from I.3.
   c. 0% of clothing costs will be subsidized for those at or above 250% of the poverty line + the assessed annual cost for all students in the household from I.3.
   d. For those between 150% and 250% of the poverty line plus costs, there will be a sliding linear scale.
   e. For students in schools where uniforms are necessary, only the non-uniform elements (such as undergarments, gym clothes, outerwear, and sneakers) will be part of the assessment.
   f. There will be hardship exemptions granted on a case-by-case basis for families with extraordinary school expenses (i.e. parents or other children attending college or university, families with sudden unexpected income changes not reflected in tax filings, etc.).

Section II: Payments
1. A regional website will be created where all families can check their eligibility.
2. Annual subsidies will be granted in the form of a nondiscript debit card mailed out no later than August 1 of the the summer preceding the next school year.
3. No information on individual students or families will be gathered, and no list of those receiving funding will be assembled or shared with districts or other public or private groups.
4. There will be no restrictions on where the card can be used.
5. If school staff notices that students are not properly dressed at school (with no knowledge of whether of not students are a part of the program), there will be a reporting website and hotline for them to inform the region so the family may be contacted to make sure outfits were purchased and are intact.

Section III: Implementation
1. Funding will be distributed beginning with the summer prior to the 2020-2021 school year.

Section IV: Enactment
1. This bill shall come into full effect immediately after being passed by this Council of Lincoln

Tourist Tax Act

A bill to tax tourist stays in Lincoln to pay up for renewal of public tourist infrastructure and develop a sustainable tourism model

Be it enacted by the Lincoln Assembly

SECTION I: The Taxable Event
1. Tourist stays in the region of Lincoln, counted by days or fraction thereof, shall comprise the taxable event regarded by this act.
2. The tourist stays in the following establishments shall be subject to this tax:
 a) Stays in hotels, tourist apartments, tourist villas and rural tourism establishment, as specified by regional tourist law
 b) Any other establishment regarded as a lodging tourist establishment by regional tourism regulations
3. The following stays shall be exempted from this tax
 a) Stays by children aged 14 and below
 b) Stays subsidized by social programs by any federal, regional, state or local administration
 c) Stays in campigns and youth hostels, as specified by regional and federal youth regulations

SECTION II: Tax payers
1. This tax shall be paid by any person or corporation who books a stay in any tourist establishment as specified in section I.2
2. The tax shall be paid at the end of the stay alongside the final bill and shall be paid for each day of the stay.
3. The tax rates established shall be as follows
 a) For 5 star hotels and apartments: 1.50$ per person per day
 b) For 4 star hotels and apartments: 1$ per person per day
 c) For any other kind of tourist establishment: 0.50$ per person per day
4. The maximum tax rate to be paid shall be equivalent to 7 days per person

SECTION III. Enactment
1. This act shall become effective one day after passage
2. The tax rates established by this act may be modified by the Lincoln budget

1. This bill may be cited as the Lincoln Assault Weapon and Automatic Weapon Ban Act.

SECTION II: ASSAULT WEAPON BAN

1. There shall be a regiowide ban on the purchasing, sale, or possession of assualt weapons, these weapons include semiautomatic rifles, pistols, and shotguns, which can accept detachable magazines, as well as revolving cylindrical shotguns.

2. Any weapon that is purchased, sold, or possessed may not have a folding or collapsible stock, a bayonet lug, a threaded barrel, a grenade launcher, or a barrel shroud.

SECTION III: AUTOMATIC WEAPON BAN

1. There shall be a ban on the purchasing, sale, or possession of fully automatic weapons, also known as Title II weapons under the National Firearms Act.

SECTION IV: LEGAL LIABILITIES FOR GUN MANUFACTURERS

1. Gun manufacturers may be sued if their weapons are used in violent crimes, by family members, close friends, and/or legal counsel of family members or close friends of gun violence victims.

2. Manufacturers may be sued for up to $15 million.

3. These cases will be be submitted to, heard, and ruled on by Lincoln's regional Justice.

SECTION V: GUN TAX

1. There shall be a 15% additional tax imposed on all shotguns

2. There shall be a 30% additional tax imposed on all handguns and pistols

3. There shall be a 50% additional tax imposed on all other firearms, that are legal to purchase, under this bill.

SECTION VI: TIMING

1. This bill shall take effect, one week after being signed by the Governor.

A bill to lower the workweek, increase employment, increase retirement age and introduce UBREDI to reduce social security costs, reduce traffic jams and reduce work pressure for Lincoln's workers to avoid burn-outs, and prepare for robotization/increased automatization of Lincoln's job market

SECTION I: DEFINING A TYPICAL AND AN ATYPICAL WORKWEEK

1. The new typical work week includes the current 8am to 5pm jobs for employees and workers.
2. The new atypical work week includes night work, morning shifts or evening shifts, and all other work weeks.

SECTION II: LOWERING WORK WEEK TO 32 HOURS

1. There shall be a workweek of 32 hours (8 hours/day) implemented for all working Atlasian citizens
2. There shall be 4 typical workweeks including 1 hour rest that shall last 8 hours
a. 20% will work from 4am to 2pm
b. 20% will work from 6am to 4pm

3. The new rest day might be chosen by the company.

3. The new rest day might be chosen by the company.

SECTION IV: RAISING THE RETIREMENT AGE TO 70 YEARS OLD
1. Retirement age shall be raised to 70 years old
2. People excluding from raising the retirement age will be:
a. People older than 60 years, born on or after 1/1/1960
b. disabled or sick persons with an attest who are still capable to work
c. high-risk employees

SECTION V: CHANGES TO SOCIAL SECURITY
1. This bill shall reduce unemployment and the pensioner's budget.
2. The unemployment income shall be reduced by 10% and shall last two years long, as long the worker is unemployed.
3. The government shall pay the rest day through a new universal basic rest day income, called UBREDI. This shall be created from the social security budget.
4. UBREDI shall cost 8 hours of the 1 dollar/hour pensioner's rate).
5. The 1.5 hours/day free shall be paid by the government pension's budget. (at the pensioner's dollar/hour rate)

SECTION VI: IMPLEMENTATION
1. This bill shall be ratified after being signed by governor, approved by 2/3rd of Lincoln councillors and after being approved by citizens due to a referendum being held.

SECTION VII: TIMING
1. This bill shall take effect on 1 january 2020

A little something I came up with (needs some amending of course Smiley )

The safety of Lincoln's citizens being fundamental to this government's actions, and with our region having a total of 25.21 deaths caused by opioid overdose for every one-hundred thousand individuals according to the National Institute on Drug Abuse's 2017 numbers, I thought this law was important.

Most provisions take inspiration upon New York's rl regulations on the subject, with some necessary exceptions and inspiration on other states' regulations. Some aspects I'd like to discuss (e.g, excise tax on opium) are, I think, better left for debate.

First Step to Relieve our Opioid Crisis Act

I. Good Samaritan Provisions.

1. Any Lincoln citizen may be allowed to call 911 or any other government-sanctioned emergency medical services phone number if they are suffering from overdose of opioid-related drugs, or if they are witness to another person in close vicinity suffering from any such overdose, without possibility or fear of arrest or prosecution of the caller or patient on any of the following offenses:

  • Possession of under eight ounces of any controlled substance.
  • Possession of alcohol (in cases of underage drinking) or marihuana.
  • Possession of drug paraphernalia.
  • Sharing of controlled substances.

2. The above provisions do not preclude arrest and prosecution over possession of over eight ounces of any controlled substance or sale of or intent to sell any such substance. They additionally do not preclude arrest in case of the existence of an arrest warrant against any citizen found at the scene of the report or a violation of parole or probation.

II. Opioid Prescriptions Regulations.

1. Any medical practitioner may not initially prescribe more than a seven-day supply of opioid medications for acute pain, said pain being defined as that the practitioner expects to last only a short period of time, caused by illness or any sort of surgical or accidental trauma.

2. Said prescriptions may additionally contain no more than 90 morphine milligram equivalents per day.

3. The prescription may be refilled after the seven days have elapsed for an equal or lower amount of time and medication by the practicing physician if he or she judges it necessary.

III. Naloxone Prescriptions and Use.

1. Any practicing physician or pharmacist may dispense or prescribe naloxone hydrochloride or other opioid antagonists to patients in risk or their immediate family members, after having undergone procedures to educate the recipient of the prescription on the proper use of said medication and on the prevention of overdoses.

2. The Lincoln Department of Health shall issue physical brochures to be handed out to patients being prescribed, dispensed, or furnished naloxone-related medication covering their proper use as well as the dangers of opium overdose, with specific content to be determined by the Department and approved by the Governor of Lincoln. The Department must also keep on its website a full version of such information for public use.

3. First responders on medical services such as paramedics or EMTs shall be required to carry naloxone when responding to claims of a factual or suspected opioid overdose.

4. The Government of Lincoln shall fund a twenty-minute video regarding the proper use of naloxone in emergency situations which will be distributed to emergency professionals followed by a forty-minute required course on the same subject with specific content to be determined by the Lincoln Department of Health and approved by the Governor, which must take place no more than four months after the start of this law's provisions. Said video must also be publicly uploaded after the courses for emergency professionals have ended.

IV. Implementation.

1. The bill shall become law after signing by the Governor, and the clauses therein prescribed will come into effect on January 1, 2020.

I'll propose amendments than

Why: because I believe people need to respect traditional and religious values, need an understanding of how a religion was formed, exist and basic stories of it, and need to learn to attend the church at least once a year. They also need to learn about other religions because it may help them understand other people's religions in class, which is necessary in a multicultural environment.

The appropriate election administrator shall open the voting booth at 12:00:00 AM, Eastern Standard Time (or Eastern Daylight Time from the second Sunday of March to the first Sunday of November.) Standard Time. Voting shall continue for 72 hours, and no vote cast more than 72 hours after the voting booth was opened shall be considered valid. The election administrator must accept any absentee ballots cast no more than 168 hours prior to the commencement of the election.

II. This Amendment takes effect after ratification by the people of Lincoln as pursuant to Article VI of the Lincoln Constitution.

Intoxicant Screening Reform Act

Section 1: Title

This legislation may be cited as the Drug Screenings Reform Act

Section II

1. It is unlawful for any employer in this Commonwealth to fail or refuse to hire a  prospective employee because the prospective employee submitted to a screening  test  and  the results of the screening test indicate the presence of marijuana.

2. The provisions of subsection 1 do not apply if the prospective employee is applying for a position:

(a) As a firefighter

(b) As someone in the following medical fields;
      I. As a medical technician
      II. As a hospital worker
           1. Possible termination may only go into effect if the drugs are commonly used for medical
               purposes in the specific occupational and residency area

(c) That requires an employee to operate a motor vehicle and for which  federal or state law  requires the employee to submit to screening tests; or


3. If an employer requires an employee to submit to a screening test within the first 30 days of employment, the employee shall have the right to submit to an additional screening test, at his
or  her  own  expense,  to  rebut  the  results  of  the  initial  screening test.  The employer shall accept and give appropriate consideration to the results of such a screening test.

Section 3: Exceptions

The provisions of this section do not apply:

(a) To the extent that they are inconsistent or otherwise in conflict with the provisions of an   employment contract or collective bargaining agreement.

(b) To the extent that they are inconsistent or otherwise in conflict with the provisions of federal law.

Section 4: Definition of "screening test"

1. As used in this section, “screening test” means a test of a person’s blood, urine, hair or saliva to detect the general presence of a controlled substance or any other drug.

Section 5: Enactment

1. This act becomes effective on January 1, 2020.

National Guard Reorganization and Modernization act

Preamble

Provided with the fact of repeated intrusions, armed insurrections, unpredictable weather patterns, and melodrama from foreign actors acted against this fine Region of Lincoln, it is safe to say that Lincoln needs to be at an equal footing to deal with threats on its sovereignty.

This legislation seeks to protect Lincoln residents by having a multirole organization to deal with events both occurring simultaneously and in need of an agile response.

Section I: Naming

1. This act shall be named the National Guard Reorganization and Modernization Act

Section II: Reorganization of Priorities
1. The National guard shall be bounded by several preconditions for deployment in Lincoln
(a) As an auxiliary force for first responders in the wake of a large scale incident
   I. Disruption of the peace by armed hostile actors
       1. May not be used in the face of protests with a lack of a heavily armed hostile actor
            (a) Heavily-armed refers to documented widespread use of firearms and explosives
   II. A lack of ability for local first responders to deal with a natural disaster
       (a) May then be allowed to intervene for the purposes of
             1. Medical assistance
             2. Preserving peace
             3. Infrastructure rebuilding
             4. Sortition of essential needs
   III. Such a severity in need of a possible deployment shall be left to the decision of the Governors personal discretion

Section III: Reorganization
1. The National Guard of Lincoln shall be organized in the following way
(a) The leading position of the force, the Chief, shall be appointed by the governor from
   I. A minimum set requirement of being
       1. Living in Lincoln as a primary resident more than 10 years
       2. Having acquired the minimum rank of an officer for the Atlasian Armed Forces for 5+ years
       3. Having no record of an act of
            I. Nepotism
            II. Embezzlement
            
(b) The National Guard of Lincoln shall be divided into Models resembling the official functions of the Atlasian Armed Forces
     I. An Army
     II. An Airforce
     III. A regional Coast Guard
     IV. An Engineer Corps
     V. A Medical Corps
(c) The standards of the National Guard shall be met by following the current standards of the Atlasian Armed forces the start of the fiscal year
(d) The budget for this National Guard shall amass to 0.5% more the cumulative budget of the other regions budget to a National Guard or equivalent force
Section IV: Nongovernmental Revenue Procurement

1. The National Guard will have a holiday every July 1st as a regional spectacle
(a) Such an event will occur where of the regional Government’s choosing
(b) Will cooperate with local businesses to create a festive environment
(c) there will be a designated area open to the public only after the purchase of tickets
2. Retired or damaged stock shall be sold for the purposes of civilian usage after modifications done to the equipment and assets to remove military-grade qualitative features so as to follow regional law

section V: implementation
1. This bill shall be made into law at January 1st, 2025

Section II: Books and Entertainment
1. The policy on prison libraries shall be as follows
 (a) All prisons, jails, or Juvenile detention sites operating in Atlasia or by the Atlasian government shall have a library
(b) It is prohibited from taking actions against reading literature if no clear danger is present to the other inmates
(c)An incarcerated individual can get a year off their sentence if a total of 3,000 hours of reading is accomplished
