Yes, and on the extreme slight chance that Coleman proves that he actually won, Franken can be expelled and Coleman installed in his place.

No. The court has not yet reached the merits of Coleman's claims.

It depends what you mean "should."

Should Harry Reid seat him?  Hell no, it's a waste of political capital and makes Democrats look bad.

Should he be seated if things were fair & just in this world?  Yes, but the GOP doesn't care about that (and neither do the Democrats on other issues).  The GOP wants a cloud of illegitimacy to surround Senator Al Franken & wants to deny the Democrats a vote for as long as possible.  The world isn't always fair.  Deal.

A position which I'm sure you held in December 2000 as well, right? Wink

I say yes, as I would have opposed any effort by Gore to extend his legal challenges beyond January 20, as well.

Gore had exhausted his remedies. His legal jig was up. Coleman's is not, and I bet you dollars to donuts more votes will be counted.

Only because the Supreme Court ruled that there wasn't any more time to extend the recount process (since the deadline for certifying electoral votes was the following day).

Not sure how, logically, the inauguration of the Congress itself isn't a greater deadline.

Yes. This is getting ridiculous... a Republican in the same position, with a Republican majority in place, would have been installed at gunpoint by now.

Another difference with Franken is that he has the capability to be seated right now through two legal methods: a temporary decision on the Senate to seat him while the courts figure out the last of the details, or a Court decision in two weeks to immediately grant Franken his certification or whatever.

So while no one is suggesting dismissing Coleman's right to contest the election, we can conclude rationally that his odds of winning are extremely minute and that the people of Minnesota deserve to have two Senators.  If Coleman wins by either antics or a miracle, then he can have his seat back.

These wait-and-see legal arguments over "should" are kinda dumb

Coleman just better hope he doesn't end up in a re-education camp once Obama establishes his socialist regime.

No, and I think Connie Mack was an example.

Actually, the "problem" is the MN Statute.

I'll add that I have no problem with an appointment to fill the vacancy.

he may be happy to attend one - at least he'll have a roof over his head.  recent reports suggest he could soon find his mortgage foreclosed.

Even if you don't like his politics, it's kind of mean to react like that to the news. I hate Al Franken, but it wouldn't make my day if he were hit by a bus.

You don't understand how horrible of a person Norm Coleman is. Besides, he can still rent somewhere. Losing a house isn't that bad.

What, specifically, makes him so bad a person that him being foreclosed is good?

Also, you're right that a Senator could easily afford to rent in Minnesota.

There are rather unique Constitutional provisions that attend the electoral college and how electors are chosen, and in any event, it was a legal conclusion of the US Supreme Court, rather than  some legal conclusion that Pubbie posters here in general have reached independently, and frankly at this juncture I don't recall the details of the merits myself.  I do however don't think SCOTUS on this one was per se rogue.
