Preliminary questions for the Defendant.  They don't necessarily need to be answered in order, though the Court would suggest that you obtain counsel

1) Do you have defense counsel or wish to request that defense counsel be appointed for you?
2) How do you plead?
3) Do you wish to waive your right to a jury trial?

For the Prosecution.

1) You gave the court the two accounts.  In which two Regions were the accounts registered in? (which will go towards selecting a jury, if we have one)

If his previous account is banned, and this is public knowledge, doesn't the SoFA have a statutory duty to remove it from the voter rolls? If so, can JC really be criminally charged with what is essentially the DoFA's neglect? Is that constitutional?

Opinion

On February 25, 2010, AG bgwah charged JewishConservative under Section 1, Clause 3 of the CCJA.  On March 3, 2010, JewishConservative plead guilty to the crime.  He has not asked for any leniency in punishment, rather saying "Just deliver my punishment.  I won't be active for a while anyway."

The Court notes that JewishConservative's account was banned prior to the second registration and subsequent charge.  Neither statute nor Constitution imposes a duty on the SoFA to remove those citizens who are banned from the voter rolls and one can imagine many good reasons why this is the case.  First and foremost, of course, this allows the SoFA and the AG to track new registrations and assure that new registrants are not retreads, and if so, can be charged for their crimes. 

We have addressed a similar issue before (see Atlasia v. Giovanni) and, likewise, do not believe that the circumstances that cause the creation of the second account determine the availability or scope of punishment against the creator.

With that in mind, the Court delivers the following punishment:

1) 90-day ban from voting in any Atlasian elections;
2) 180-day ban holding any office under the Republic of Atlasia.

So ordered.
